The project was necessitated by the partial failure and collapse of a long-existing retaining wall on June 26,2012. You and I have discussed more than once the possible need for an after-the-fact CUP because of the amount of fill used in the project by the contractor, Landscape Renovations Inc. Enclosed is the final invoice by LRI dated September 18, 2013, showing a line item for 45 cubic yazds of soil (black dirt non-pulverized)("Soil 1")and a line item for 15 cubic yards of soil(garden blend) ("Soi12"). I understand that the City's threshold for obtaining a CUP was recently raised to 50 cubic yards of fill within 75 feet of public waters. I have spoken to Bob Palmer,a co-owner of LRI and the project manager on this project. Bob has advised me that Soi12 is technically not "fill" but a"soil amendment" for the planting of the perennials on the sloping garden. In addition,Bob estimates that 15 cubic yards of the Soil 1 were used on the Honours'property adjoining to the south for the installation of new sod and the repair of tracks left in their yazd by the heavy equipment.
