Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subd. 1. Type of data. The rights of individual on whom the data is srored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individual. An individual asked to supply pnvate or confidential data conceming himself shall be
informed of: (a)the purpose and intended use of the requested data wi[hin the collecting state agency,political subdivision,or statewide system;(b)
whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply
private or confidential data;and(d)the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall
not apply when an individual is asked to supply investigative data,pursuant to section 13.82,subdivision 5,to a law enforcement ofticer.
The commissioner of revenue mav alace[he notice required under[his subdivision in the individual income tax or propertv tax refund
instructions instead of on those forms.
Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed whether he is the subject of
stored data on individuals,and whether it is classified as public,priva[e or confidential. Upon his further request,an individual who is the subject of
stored private or public data on individuals shall be shown the data without any charge ro him and,if he desires,shall be informed of the content and
meaning of that da[a. After an individual has been shown the private data and informed of its meaning,the data need not be disclosed to him for six
months thereafter unless a dispute or action pursuant to this sec[ion is pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority
may require the requesting person to pay the actual costs of making,certifying,and compiling the copies.
The responsible authority shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days of
the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request
within[hat time,he shall so inform the individual,and may have an additional five days within which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data
conceming himself. To exercise this right,an individual shall notify in writing the responsible authority describing the nature ofthe disagreement. The
responsible authority shall within 30 days either. (a)correct the data found to be inaccurate or incomplete and a[tempt to notify past recipients of
inaccurate or incomplete data,induding recipients named by the individual;or(b)notify the individual that he believes the data to be correcL Data in
dispute shall be disdosed only if the individual's statement of disagreement is induded with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to
contested cases.

Tom Kellogg, City Engineer, and I reviewed your survey and grading plan. To do a
more complete review we need the following added to the plan:
1. Existing contours should be labeled.
2. Proposed contours need to tie to existing contours.
3. The average lakeshore setback. The average lakeshore setback is a line
between the point of the adjacent houses that is closest to the lake. A deck is
ignored unless the top of the deck railing is more than six feet above grade.
There is not a separate setback for houses and decks.
4. Contours 50 feet into the adjacent properties and spot elevations at the adjacent
house corners. (Other information such as the hardcover calculations and floor
elevations should not be placed over this information.)
5. Source of the topo. (We want to make sure it is based on a field survey rather
than aerial topography.)
Without this information Tom was unable to do a complete review. He did note that
swales need to be provided along both the north and south property lines.
Do not reduce the size of the plan. Attached is a form for hardcover calculations to use

Subject: Grading Plan for Building Permit Application — 1500 Bohns Point Road

I received your updated survey and grading plan. In reviewing it I found a change is
needed in the elevation of the house:
The zoning code limits a house to two stories plus a half-story and 30 feet defined
height. For the lowest level (the basement) to be not counted as a story the first floor
must be no more than six feet above existinq grade for at least 50 percent of the
perimeter of the lowest level. (This was changed earlier this year. Prior to that the six
feet was measured up from the basement floor.)
Based on the house plans it appears the main floor elevation will be 966. This would
mean that 50 percent of the basement perimeter needs to be where the existing grade
is 960 or higher for the basement to not be considered a story. But it is not. If the first
floor elevation were 959 it would work.
In comparing this plan to the previous plan I see that the 960 contour was missing.
What I thought was probably the 960 contour is actually the edge of the driveway.

We have reviewed the plans for 1500 Bohns Point Road, dated 9-8-07. We have the following comments
with regards to engineering matters:
• The drainage swale indicated on the plans should be verified to function and contain stormwater
to the property. Minor grading changes may be necessary,
• Engineered design and details must be submitted for review and approval for all retaining walls
over 4' in height, and for all tiered walls with a separation of less than two times the wall height.
• The proposed slopes exceed the maximum allowable slope of 3:1 to the north of the proposed
house. The grading should be revised in this area such that slopes do not exceed 3:1,
