On March 12, 2013 the City received a zoning permit aE � ��� � '/ ;ation is

The following items must be submitted or revised in ordE 1�����-'��`+�` �/w � and for
the plan review to continue:
1. Certificate of Survey. A certificate of survey d �lication.
There are a couple of additional items required t�
a. The top and bottom of the retaining wall graded)
should be shown.
b. The survey and hardcover calculations show a wood pump cover to be removea �item L). Is a
new cover going to be installed in its place? Is there any grading or land alteration proposed?
Please clarify.
c. The survey and hardcover calculations show a shed and landing (Items N and O) to be removed.
Is there any grading or land alteration proposed with the removal? Please clarify.
2. Building Permit. The newly proposed retaining walls near the existing shed (Item B) are over four feet in
height. Retaining walls greater than four feet in height require a building permit and engineered plans.
Attached is a building permit application. Please return the building permit application with all the
required submittals.
3. Variance. One of the proposed retaining walls near the existing shed (Item B) is shown less than five
feet from the property line and should be revised to meet the required five foot setback. If you wish to
apply for a side yard setback variance to permit the wall to be in the location shown, return the variance
application along with all the required submittals. A copy of the variance application is attached.
4. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer require
/ submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
�,� �imbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
�V"this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $2,500. The escrow agreement is enclosed.
The property owner must sign the escrow agreement and submit a check for$2,500.

RE: Building Permit Numbers 2013-00166 & 2013-00253
Hello,
In the process of closing out completed building permit project files, it was noted there has not
been a final inspection or an as-built survey and hardcover calculations submitted for the
retaining wall and land alteration.
We continue to hold an escrow of $2,500 pertaining to the project. As noted on the issued
building permits (copies attached), an as-built survey and hardcover calculations are required
prior to escrow release. Once the weather permits, have an as-built survey and hardcover
calculations prepared by a surveyor and submitted to us. Your escrow will be refunded once
our engineer determines the property conforms to the approved permit plans, approved grading
plan, etc. Please see the attached City code section regarding survey requirements.

Sec. 86-68. Permit application; information required.
(a) The application for a construction permit shall include such information as may be required by the
city, which may vary between types of construction projects.
(b) Surveys required:
(1) Initial survey. Any building or general permit application for construction of a new structure or
expansion of an existing structure shall be accompanied by a certificate of survey prepared
by a Minnesota Registered Land Surveyor unless the building official determines the
construction project is exempt from this section. The certificate of survey shall conform to the
standards on file in the office of the building official.
(2) Foundation survey. A foundation survey shall be submitted to the city for review and
approval, unless exempted by the building official, upon completion of the foundation work for
all buildings and all additions to buildings. The foundation survey, prepared by a Minnesota
Registered Land Surveyor, shall certify the lot dimensions; front, side, rear, lakeshore, and
wetland setbacks; and foundation elevation. A foundation survey must be submitted before
proceeding with framing or further construction. In lieu of a survey a letter prepared by a
Minnesota Registered Land Surveyor containing the same information as a foundation survey
may be submitted.
(3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land Surveyor, shall
be submitted to the city for review and approval upon the completion of all buildings and all
additions to buildings, unless exempted by the building official. The as-built survey shall
certify the final topography of the site; verify drainage patterns; and provide hardcover
calculations for lots in the Shoreland Overlay District. An as-built survey must be approved
before the issuance of a certificate of occupancy. In the event that weather or other
conditions prevent the completion of an as-built survey at the time the Certificate of
Occupancy is requested, applicant shall provide a sufficient financial guarantee and establish
an escrow agreement to ensure completion of the as-built survey.
