Lots under 2 acres in size are limited to 15%structural coverage; for this property 15%= 2,827 s.f. According to the
structural square footages provided on the hardcover calculation worksheet the property is at 15.89%or 2,995 s.f. of
structural coverage or 168 s.f. over.
Adding a 2"d level to the house over the existing structural footprint doesn't add structural coverage to the property.
However, according to the building code (R311.4.3) a 36" x 36" landing is required outside the screen porch door in
addition to the stairs. The landing and stair are considered structural coverage. Staff cannot administratively approve
an overage in structural coverage. Please modify the plans to incorporate the landin�and stairs into the structure
without increasin�structural covera�e over the existin� 2,995 s.f. and remain within the existin�footprint. Submit two
updated copies of each the plans and hardcover calculation of our review.

Here are the files with the cross section added. Not to much to show, but I did add the top of floor elevation
markers. I based the existing floors off of what was sent and then calculated out the top of the new 2nd floor.

return. We have received the escrow money of$2,500 we just need the agreement signed and returned before we
issue the building permit.
Also, I need additional information in order to do the number of stories calculation. Please submit two copies of a cross
section of the home along with showing us what the first floor elevation (FFE) is.
I don't believe your project will trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements;
however please contact the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will
not issue a building permit without a copy of MCWD permits or documentation from the MCWD stating the proposed
project does not trigger any of their permitting requirements.
PLEASE NOTE 2015 NEW PERMIT REQUIREMENT: Prior to the commencement of � exterior/landscaping
improvements, i.e. patios,grading, sidewalks, retaining walls, etc., a Zoning Permit is required.

Thank you for re-sending the email. As I suspected and mentioned to you yesterday, the context of the email I sent to
the property owner in 2012 was for a roof over an existing deck. The plans submitted recently by you are for a
completely different type and magnitude of a project.
Before we can proceed we our review you need to pay the advanced plan review fee: $1,400.59. You can call 952-249-
4600 and pay with a credit card or drop off or mail a check.
In order for your application to be considered complete and to proceed with its review, we need the following:
1. Certificate of Survey. Please provide two copies of an updated, full size certificate of survey which meets all of
the City's survey standards (enclosed), including average lakeshore setback and any proposed grading for
creating the walkout. A landing must be shown as required by the building code and included in the hardcover
calculations.
2. Building Height. All buildings in Orono are allowed a maximum defined height of 30 feet and must not exceed 2
% stories as defined within City Code Section 78-1. We currently do not have enough information to perform
these calculations. Attached is our sheet on Building Height which includes the definition of a basement for
your information.
3. Side yard setback. Attached is partial copy of a survey from our file showing the existing garage which extends
two feet into the required 10-foot side yard setback. Any proposed changes to the footprint or roof line within
the 10-foot setback will require a variance.
4. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District. Please
have the surveyor prepare hardcover calculations, showing existing and proposed hardcover. Attached is a copy
of our hardcover information packet.
5. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
amount for this project is$2,500. The escrow agreement is enclosed. The property owner must sign the escrow
agreement and submit a check for$2,500.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building
permit without a copy of MCWD permits or documentation from the MCWD stating the proposed project does not
trigger any of their permitting requirements.

I thought it would be good to forward you the email below which addresses a potential for a variance needed to add the
roof over the screened in porch, as you can see, we looked into this a while ago. Originally they said it would need to go
to a variance committee but after we talked to them about the fact there was already a hard surface over the area (the
decking) they determined no variance was needed. They mentioned there was a cost associated with the variance
process so hopefully this will save some money.

As we discussed on the phone it appears no variance is needed for your project. Since the deck is already
considered a structure (i.e. structural coverage) because it is at least 6' above grade and does not encroach

into any setbacks a roof is allowed. The new roof must not encroach into the average lakeshore setback or the
10-foot side yard setback.
In 2004 a variance was granted to allow construction of a larger front stoop including a roof. With the approval
of this variance 102 sq. ft. of hardcover was to be removed. I have attached a copy of the variance resolution
for your records. The hardcover removals are specified on page 3 of 6 and shown on Exhibit A.
Building permits that do not require any grading or engineering review require a $700 escrow. We hold the
escrow until the project is complete and the building inspector has given the final approval. Before we refund
the building permit escrow you will be required to submit an as-built survey, including as-built hardcover
calculations, showing the property is in compliance with the 2004 variance.

3. The City will commence its review of the application and incur costs associated with said review
oniy if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTfES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCR�W FUNDS. Contemporaneously with the execution of this Escrow
Agreement, ttte Owners shall deposit$2,500 with the City. Ail accrued interest, if any, shall be paid to the City to
reimburse the City for i#s cost in administering the escrow account.
Z. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for aN out�f-pocket costs the City has incurred (including planning, enqineerfnp, in excess of 5500, or legal
consuftant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permi# application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution P�evention Plan and the provisions of Orono Ciry Code Chapter 79.
The finencial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work(including planning,
engir�eering, or legai consultant review) associated with building permit # 2�I5 -G01 Zq if
complsance with the approved building perrnit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred casts, the City will in turn
se�� a bi!! to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
re�e�p�gf bill.
I 4. DISBURSEMENT FROM ESCRQW AGCOUNT. In the event that the Owners do not make payment
tg&�e Ciry within the timeftame outlined in#3 above, shall issue a Stop Work Order untit the Owners pay ail expenses
in�rc�ceci pursuant to #3. The City may draw ftom the escrow account without further approval of the Owners to
rei�#�;rse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to the
t>wn��s when all requirements related to the project are complste. City S#aff shall review the terms of this escrow
�wr�ernent two times per yea� to determine whether the requirements of the project have been successfully
�p#eted and whether it is appropriate to retum the funds. Owner may also request the release of the funds,
aj-s� sact�funds shaA be released upon City Staff receiving the appropriate verification that all requirements of the
�ro�ect have been successfully completed.
6. CERTIFY UNPAID CMARGES. IF the project is abandoned by Owners,or if the eligible expenses
�^���red by the City exceed the amount in escrow, the City shall have the right to certify tl�e unpaid balance to the
s;��;e�property pursuan#to Minn. Stat. §§415.01 and 366.012.
