A RESOLDTION GRANTING
A VARIANCE TO
MUNICIPAL ZONING CODE
SECTION 10.22, SIIBDIVISION 2
FILE #1106
WHEREAS, R.F. Potas (hereinafter "the applicant") is the owner of
the property located at 2190 Shadywood Road within the City of Orono
(hereinafter "City") and legally described as follows:
Lots 14 and 15, Block l, Wiley's Park Lake Minnetonka, Hennepin
County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicant has applied to the City for a variance to
Municipal Zoning Code Section 10.22 , Subdivision 2 to permit the
construction of a deck at the main f loor level of his residence, which deck
will constitute additional structural hardcover in the 75-250' lakeshore
setback zone in which the property already exceeds the 25� hardcover limit.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota: �
FINDINGS
1: This application was reviewed as Zoning File #�1106.
2. The property is located in the LR-1C Single Family Lakeshore
Residential Zoning District.
3. The Orono Planning Commission reviewed the applicant's original
proposal on February 17 and March 16, 1987, which proposal included a
deck and an enclosed porch which would have required variances for
hardcover and for average lakeshore setback. On March 16, 1987,
Planning Commission voted 5-2 to deny such variances.
4. The applicant on April 8, 1987 revised his request to construct
only a deck at the main floor level, such deck to extend only 15'
toward the lake from the existing house, thereby not encroaching on
the average lakeshore setback as defined by the existing decks on the
two adjacent properties, such deck considered as a non-encroachment
per Municipal Zoning Code Section 10.03, Subdivision 15 (C).
5. The proposed deck comprises 763 s.f. of new structural hardcover
in the 75-250' lakeshore setback zone which currently contains 46.7$
� hardcover where only 25� is normally allowed. Applicant proposes to
remove 1,100 s.f. of existing hardcover in the 75-250' zone, resulting
in a net decrease in 75-250' hardcover of 537 s.f. for a final 75-250'
hardcover of 43.7�. Applicant further proposed to reduce his 250-500'
hardcover by 360 s.f. for a net decrease from 42.0� to 36.1�.

6. The City Council has considered this application including the
findings and recommendations of the Planning Commission, reports by
City staff, comments by the applicant and the effect of the proposed
variance on the health, safety and welfare of the community.
7. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variance would not
adversely affect traffic conditions, light, air nor pose a fire hazard
or other danger to neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to al leviate a demon-
strable hardship or difficulty; is necessary to preserve a substantial
property right of the applicant; and would be in keeping with the
• spirit and intent of the Zoning Code and Comprehensive Plan of the
City.
CONCLIISIONS, ORDffit AND CONDITIONS
Based upon the above findings, the Orono City Council hereby
grants a variance to the Municipal Zoning Code Section 10.22, Subdivision 2
to permit the construction of a deck at the main floor level of the
residence per Exhibit A attached, which deck constitutes hardcover in
excess of the 25$ hardcover allowance in the 75-250' lakeshore setback
zone, subject to the following conditions:
l. The deck shall be located as shown in Exhibit A attached and shall
not be enclosed, nor shall it have a hand railing that exceeds the
standard 36" height above the deck platform.
2. Applicant shall remove the following areas of existing hardcover
on the property, by removing the plastic sheeting underlying the rock
beds:

4. Applicant is advised that future proposed additions resulting in
further increases of hardcover will likely be disapproved but might be
approved only with concurrent reductions of existing hardcover at that
time.
5. Authorities granted by this variance run with the property not
with the applicant, but are permissive only and must be exercised by
application for a building permit within one year of the date of
Council approval, or this variance will expire on that date (April 13,
1988) .
6. Violation of or non-compliance with any of the terms and
conditions of this variance shal 1 constitute a violation of the zoning
code, shall automatically terminate any authority granted herein, and
shall be punishable as a misdemeanor.
7. The undersigned applicant has read, understood and hereby agrees
to the terms of this resolution and on behalf of himself, his heirs,
� successors and assigns, hereby agrees to the recording of this
resolution in the chain of title of the property.
