Subject: Lot Line Rearrangement: Peterson/Shemanek, 4385/4355 Chippewa Lane
Peterson/Fritzler have acquired the ta�c forfeit parcel to the rear of their property and have signed an
application for legal combination with their homestead parcel. The resulting parcel is L-shaped and
extends behind Shemanek's property.
They wish to move the boundary so that Shemanek gains the portion of the L directly behind him.
This appears to be logical. Both resulting lots will continue to meet the requirements of the Zoning
Chapter. Per the definition of'Subdivision' (11.03 Subd. 2.65)this rearrangement is technically not
a subdivision and therefore is exempt from the subdivision process. Per 11.10 Subd. 3B, we must
certify that the subdivision regulations do not apply. The attached quit-claim deed has a place for
you to make the certification.
I assume there is an easement over the long narrow strip in favor of properties south of the Luce
Line. I think such an easement is inconsequential regarding this proposed rearrangement.
This memo serves as your authorization to certify this division/combination.

SEC. 11.10. SQBDIVISION APPLICATION PROCEDQRE, APPROVAL r
PROCESS, AND REQQIREA'fENTS. L
Subd. 1. Restrictions on Development Prior� to Final Plat r
Approval. Once a preliminary plat has been submitted to the City, �
no building permits will be issued by the City for the construction
of any building, structure or improvement to the land or to any lot
in the proposed subdivision until all requirements of this Chapter �
have been fully completed including the official recording of the
final plat, or until the application is formally withdrawn by the
subdivider. When specifically authorized by this Chapter and r
specifically approved by the Council, permits may be issued for the L
construction of certain improvements such as roads, utilities and
drainage structures.
Subd. 2. Coordination of Flexible Zoning App�ication �
With Subdivision Approval.
A. Intent. It is the intent of this Chapter that �
subdivision review be carried out simultaneously with the review of
flexible zoning applications.
B. Fees. Whenever a proposed subdivision includes (�
a use of land requiring flexible zoning approval, the subdivider �
shall file the separate flexible zoning applications and pay all
� required fees concurrent with the filing of the Preliminary Plat �
application.
C. Review. Review of the flexible zoning
application shall be concurrent with review of the Preliminary Plat
and any flexible zoning approval shall be contingent upon approval �
and subsequent recording of the Final Plat.
Subd. 3. Official Submission Dates, �
A. For the purpose of this Chapter a subdivision
application shall be preliminarily approved or disapproved by the
City within 120 days following the delivery of an application �
completed in compliance with the City Code by the applicant to the
City, unless an extension of the review period has been agreed to
in writing by the applicant. _ �

regulations of the City do not apply is presented to the City, the
Clerk of the City shall within ten days certify that the �
subdivision regulations of the City do not apply to the particular

ment of conveyance has been presented to the clerk of the mw�icipality, the provisions of

This letter is to confirm our discussion of February 24 regarding the potential to subdivide the property at
4355 Chippewa Lane. This property is approximately 7 acres in area and is located within Orono's RR-lA
Rural Residential Zoning District.
The RR-lA District requires a minimum lot size of 5.0 acres. Any proposed subdivision of property in the
RR-lA District must result in conforming 5-acre lots. Your suggestion of subdividing in a manner that
would place the existing residence and outbuildings on a new 2-acre parcel and leave a 5-acre vacant parcel,
cannot be approved, because the 2-acre parcel would not meet the 5-acre minimum area requirement.
You and I discussed the possibility of a lot line rearrangement that would leave the existing residence and
outbuildings on a 5-acre parcel, allowing sale of the remaining two acres to an abutting property owner for
legal combination with his/her land. This option only works if one of the abutting neighbors is a willing
purchaser.
You did ask about the possibility of a lot area variance. Lot area variances for new subdivisions are virtually
never approved by the City Council,and this property does not e�chibit any unique circumstances that might
lead to such approval. The fact that the Shemanek's owned this property prior to the 1975 City-wide
rezoning does not give it any grandfather rights; if it had existed as two conforming tax parcels prior to that
rezoning and had remained as two tax parcels since then, it might have been eligible for a lot area variance
for an existing lot. But that is not the case, hence I believe your only option for subdividing is the lot line
rearrangement with a neighbor.
