On April 2, 2013 the City received a building permit application for a deck . Your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and
for the plan review to continue:
1. Certificate of Survey. Please provide 2 copies of an updated, full size certificate of survey which meets
all of the City's survey standards (enclosed) indicating the location of the proposed deck (and any
proposed grading) as well as all existing buildings, structures, landscaping, retaining walls and hardcover
on the property.
2. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow for building permits is $2,500. Since the project does not require any
land alterations, an escrow of $700 will be required. The escrow agreement is enclosed. The property
owner must sign the escrow agreement and submit a check for$700.

RE: City Code Violation at 4325 Chippewa Lane

We have become aware that recently a deck has been built at 4325 Chippewa Lane without a
proper City permit. Construction without a proper permit is a violation of City Code Section
86-66. Furthermore, 4325 Chippewa Lane is located in the RR-1A zoning district which requires
100' front and rear setbacks and 50' side yard setbacks. The City believes the newly
constructed deck does not meet the required side yard setback of 50'.
This letter will serve as your notice that the property must be brought into compliance
before Thursdav, Auqust 22, 2013. In order to bring the property into compliance the deck
must be removed.
If you are interested in requesting City Council approval to allow the deck to remain in a non-
conforming location, you must apply for an after-the-fact variance. A variance application fee is
$700 and an after-the-fact variance requires a double fee for a total of $1,400, plus a $2,500
escrow. The application fees are not refundable. Attached is a copy of the variance application.
If a variance is being pursued, a variance application must be received before Wednesday,
August 21, 2013. If an after-the-fact variance is not applied for, the deck must be removed
by Thursday, August 22, 2013.

It is unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove, convert,
or demolish any building or structure, or any part or portion, including but not limited to the general
construction, plumbing, water well, on-site sewage treatment system, wood stoves and fireplaces,
ventilating, heating or air conditioning systems, or cause such work to be done, without first obtaining a
separate building or general permit for each such buifding, structure or separate component from the
city.
