141 Chevy Chase Drive
This letter is regarding the building permit application for your property received on June 16, 2011 for two additions
to the home at 141 Chevy Chase Drive. Our cursory review indicates that your application is incomplete. As discussed
in your telephone conversations with Christine,the following items must be submitted in order for your application to
be considered complete and for the plan review to continue:
1. Wetland Delineation. City maps indicate a Preserve classification wetland is on or near the south property
line,where one of the proposed additions is located.This map is attached, A Preserve wetland requires a 50'
buffer and a 20' structure setback; a wetland delineation is necessary to determine the edge of the wetland.
Following completion, the wetland delineation must be submitted to the Minnehaha Creek Watershed
Distrid(MCWD)for their approval.
2. Wetland Buffer. This project may trigger the City's Wetlands Protection regulations (City Code Chapter 78
Article XI)which require vegetative buffers be established. If the project triggers the wetland regulations,the
buffer must be evaluated by staff and possibly a plan may be required for the buffer improvements.
3. Certificate of Survey. Thank you for submitting the revised survey, received today, showing both proposed
additions. Once the wetland delineation is completed the survey must be revised to reflect this information.
4. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City of out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required
escrow amount for this project is $2,500; the escrow agreement is enclosed. The property owner must sign
the escrow agreement and subrnit a check for$2,500. Please note,there may be additional, separate escrow
requirements regarding wetland buffer establishment.

BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2011-00476
AGREEMENT made this day of , 20_, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Roger Remark ('Owners").
Recitals
1. A building permit application has been filed for two proposed additions located at
141 Chevy Chase Drive the ("Subject Property"), legaliy described as Lot 21, Block 1, Hill O' Way Manor,
Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including pianning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit apptication. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2011-00476 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a biil to the Owners. Owners shall be responsibie for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shali be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligibie expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

We have reviewed the plans for a proposed garage addition to the existing home at 141 Chevy
Chase Drive. The plans are dated 8-9-11. We have the following comments with regards to
engineering matters:
• The proposed driveway and grading adjacent to the proposed garage is acceptable from
an engineering standpoint.
• The proposed rain garden must have an under drain system (draintile) to function
properly.
• Please see the attached memo from John Smyth dated 8-31-11 for comments regarding
the wetland buffer.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial security should
be required of the owner for this permit.

Re: Wetland Buffer Variance Review 11-3524
I have reviewed the Wetland Buffer Variance Application completed by Arrowhead Environmental
Consulting on behalf of the Remarks.
The proposed improvements to mitigate the loss of the buffer include expansion of the buffer
along the east and south half of the lot. The proposed location of the buffer would help
filter/treat the backyard drainage that drains from north to south. South of the house where
expansion of the buffer is not possible they have proposed a rain garden. This wiil help mitigate
the loss of wetiand buffer that would exist at this location and provide treatment of the new
impervious surface being added by the garage.
In order to insure that the improvements wiil function, more detail should be provided for the
native vegetation establishment in the buffer and overall rain garden design. For the wetland
buffer site preparation, seeding approach, as well as seeding and planting locations and species
should be provided.
For the rain garden, in addition to the tile recommended by Darren Amundsen, it is recommended
that a soil correction occur in the location of the rain garden to insure infiltration to the tile. This
requires that 18 - 24 inches of the existing soil be removed and replaced with planting media.
The proposed elevation of the top and bottom of the rain garden should be provided. A typical X-
section of a rain garden is provided below.

Roger,
Please find attached a proposal for the raingarden and buffer area planting. Hopefully this proposal will provide the detail
that is needed by the city.
I am not totally clear on the timeline, but my sense is that the raingarden will be ready to go this fall and that we would
plant it then. The buffer area needs a couple herbicide applications so it won't be ready to be seeded until probably next
June.
