Strauman and Roger E. Strauman (hereinafter "the applicants") are owners of the property located at 123 Chevy Chase Drive within the City of Orono (hereinafter "City") and legally described as follows: Lot 12, Block 1, Hill O'Way Manor, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on February 16, 1999, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the applicants have applied to the City for variances to Municipal Zoning Code Section 10.20, Subdivision 5 (B) to permit a lot area variance to remove the existing residence to allow for a new residence to be constructed where .529 acres is the total lot area and a minimum of 1 acre is required. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #2455. 2. The property is located in the R-lA Zoning District, where 1 acre or 43,560 sq. ft. is the minimum lot area. The property consists of .529 acres. 3. The Planning Commission reviewed this application on February 16, 1999, and recommended approval on a vote of 4 to 0. The proposed residence will meet the minimum setback requirements for the R-lA Zoning District. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.20, Subdivision 5 (B) to permit the existing residence to be removed to allow for new construction on a lot with .529 acres where 1 acre is required. Approval was subject to the following conditions: 1. The applicants shall apply for a demolition permit. 2. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (February 22, 2000). 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
