• RESOLUTION OF THE CITY COUNCIL

� � � A RESOLIITION ORDERING ABATEMENT
OF HAZARDOIIS BQILDING ACTION AT
200 HOLLANDER ROAD, ORONO
WHEREAS, the City of Orono is a municipal corporation organized
and existing under- the laws of the State of Minnesota; and
WHEREAS, Roger W. Hollander, personal representative of the
Estate of Hildur P. Hollander, of the property located at 200 Hollander
Road, Orono, Minn�sota, herein referred to as "the property", and legally
described as follows:
Outlot B, Holly Acres, Hennepin County, Minnesota
WHEREAS, the City Council of the City of Orono, having duly
considered the matter pursuant to Minnesota Statutes Sections 463.15 to
463.261, hereby finds that the garage structure at the above described
property is . uninhabitable and contains unsanitary and hazardous conditions
which constitute a public nuisance and which makes this property hazardous
to the public health, safety and welfare based on the following findings:
� • 1. Roof shingles have been badly weathered
2. Soffit boards are rotten and falling down
. 3. There is a dirt floor in building
4 . No header above overhead garage door
5. Garage door has rotted into pieces
6.Concrete block has shattered on the south wal 1 _
7. Electrical may or may not be energized, but is in need of
replacement
8. Building is in a state of deterioration and dilapidation, thus it
is a safety and health hazard pursuant to Minnesota State Building
Code/Uniform Building Code, Section 203.
9. Orders to removed the structure were issued by the Building
Official on 2/13/87. These orders have not been complied with.
NOW, THEREFORE, BE IT RESOLVED as fol lows:
1. That the City Council of the City of Orono, pursuant to State
� Statute 463.251, hereby orders the owner(s) to board-up and secure the
structure within 10 days. The City Council further orders that unless
corrective action is taken within 10 days from the date of service of
this order, it will result in the City properly securing the building
and the cost thereof will be charged against the real estate as
- provided in State Statute Section 463.21. - - �

2. That the City Counci 1 of the City of Orono, pursuant to the
foregoing findings and in accordance with Minnesota Statutes Sections
463.15 to 463.261 hereby orders the owner(s) of the property to raze
and remove the structure on the property. The Council further orders
that all personal property or fixtures that may unreasonably interface
with the razing be removed within twenty (20) days of the service of
this order o� the City of Orono may remove and sell such personal
property or fixtures at a public auction in accordance with the law.
3. The City Council of the City of Orono further orders that unless
this corrective action is taken or an answer is served upon the City
of Orono and filed in the office of the Clerk of District Court of
Hennepin County, Minnesota, within twenty (20) days from the date of
the service of this order, a motion for summary enforcement of this
order will be made at District Court of Hennepin County.
4. That the City Council of the City of Orono further orders that if
the City is compel led to take corrective action herein all necessary
• costs expended by the City will be assessed against the real estate
concerned and col lected in accordance with Minnesota Statute, Section
463. 22.
5. That the City Council of the City of Orono hereby authorizes and
� directs the Mayor, City Clerk, City Attorney, and other officers and
employees of the City to take such action, prepare, sign and serve
such papers as are necessary to comply with this Order and to assess
the cost thereof against the real estate described above for
col lection along with taxes.
Adopted by the City Council of the City of Orono, Minnesota, this
23rd day of February, 1987.
