HomeMy WebLinkAboutResolution 2140 � r ' _ «,�.r . . _ �� � Ci.t� o� ORONO � • RESOLUTION OF THE CITY COUNCI L � NO. 2140 • - � • A RESOLDTIOAi ORDERING ABATEMENT OF HAZARDODS BUILDING ACTION AT ' 200 HOI,LANDER ROAD, ORONO WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, Roger W. Hollander, personal representative of the Estate of Hildur P. Hollander, of the property located at 200 Hollander Road, Orono, Minnesota, herein referred to as "the property", and legally described as follows: Outlot B, Holly Acres, Hennepin County, Minnesota WHEREAS, the City Council of the City of Orono, having duly considered the matter pursuant to Minnesota Statutes Sections 463.15 to 463.261, hereby finds that the barn located on the south side of the above described property is uninhabitable and contains unsanitary and hazardous conditions which constitute a public nuisance and which makes this property • hazardous to the public health, safety and welfare based on the following findings: Lower Level: l. Concrete block has cracked in some places from movement of earth 2. East wall (concrete b�lock) is bowed in about 4 or 5 inches for approximately 25 feet 3. Building is not being used Upper Level: l. North wall is pushed out by the door 2. Posts by door also appear to be leaning 3. Hole in roof, southwest corner 4. Interior beams have improper bearing - 5. Building is in a state of deterioration and dilapidation, thus it is a safety and health hazard pursuant to Minnesota State Building Code/Uniform Building Code, Section 203. • 6. Orders to removed the structure were issued by the Building Official on 2/13/87. These orders have not been complied with. NOW, THER$FORE, BE IT RESOLVED as follows: Page 1 of 2 . _ ' � �Y:. `� � Cit� o� ORONO � R�SOLUTION OF THE CITY COUNCIL � NO. 2140 • - • • t the City Council of the City of Orono, pursuant to State Statute 463.251, hereby orders the owner(s) to board-up and secure the structure within 10 days. The City Council further orders that unless corrective action is taken within 10 days from the date of service of this order, it will result in the City properly securing the building and the cost thereof will be charged against the real estate as provided in State Statute Section 463.21. 2. That the , City Council of the City of Orono, pursuant to the foregoing findings and in accordance with Minnesota Statutes Sections 4 6 3.15 to 4 6 3.2 61 hereby orders the owner(s) of the property to ra ze and remove the structure on the property. The Council further orders that all personal property or fixtures that may unreasonably interface with the razing be removed within twenty (20) days of the service of this order or the City of Orono may remove and se11 such personal property or fixtures at a public auction in accordance with the law. 3. The City Council of the City of Orono further orders that unless this corrective action is taken or an answer is served upon the City of Orono and filed in the office of the Clerk of District Court of • Hennepin County, Minnesota, within twenty (2 0) days f rom the date of the service of this order, a motion for summary enforcement of this order will be made at District Court of Hennepin County. 4. That the City Council of the City of Orono further orders that if the City is compelled to take corrective action herein all necessary costs expended by the City will be assessed against the real estate , concerned and collected in accordance with Minnesota Statute, Section 463.22. � 5. That the City Council of the City of Orono hereby authorizes and directs the Mayor, City Clerk, City Attorney, and other officers and employees of the City to take such action, prepare, sign and serve such papers as are necessary to comply with this Order and to assess the cost thereof against the real estate described above for col lection along with taxes.
