A RESOLDTION VACATING AN IINUSED PORTION
OF A DEDICATED DRAINAGE EASEMEIJT
AT 2020 AND 2080 SALEM CODRT
WITHIN THE PLAT OF DICREY I�ARE ADDITION
SECTION 27, TOWNSHIP 117, RANGE 23
IN THE CITY OF ORONO, MINNESOTA

WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREASr on December 19, 1987, Van Eeckhout Building Corporation,
on behalf of Roger and Connie Plank and Gary Roderick Construction, Inc.
filed a petition with the City of Orono requesting the vacation of a
portion of drainage and utility easements originally dedicated within the
plat of Dickey Lake Addition, legally described as follows:
The east 5.00 feet of Lot 2, Block 1, DICKEY LAKE ADDITION, according
to the recorded plat thereof, Hennepin County, Minnesota lying
• northerly of the southerly 10.00 feet and southerly of the north 5.00
feet thereof. Also:
The west 5.00 feet of Lot 1, Block 1, DICKEY LARE ADDITION lying
norther].y of the southerly 10.00 feet and southerly of the north 5.00
f eet thereof.
WHEREAS, after due published and posted notice, a public hearing
• was held before the City Planning Commission on January 20, 1987, regarding
said vacation and all persons interested were given an opportunity to be
heard; and
WH]3REAS, after due standing and consideration, the Planning
Commission recommended approval of the requested vacation and the Council
of the City of Orono finds that said vacation, as proposed, is in keeping
with the public interest in consideration of the following findings:
1. The vacation does not affect access to or use of any adjoining
property.
2. The City has not and does not intend to develop, improve or use
the portion of dedicated drainage and utility easement described
above.
3. The portion of dedicated drainage and utility easement as it
exists serves no public purpose.
• 4. The portion of dedicated drainage and utility easement, as � a
result of a recent lot line rearrangement no longer coincides with the
boundary between the properties at 2020 and 2080 Salem Court. �

NOW, THEREFORE, BE IT RESOLVED, that the petition of Van Eeckhout
Building Corporation, Roger and Connie Plank, and Gary Roderick
Construction, Inc. is hereby granted and that the portion of dedicated
drainage and utili,ty easement legally described above is hereby vacated.
The granting of the petition is subject to the following conditions: �
l. Applicants shall provide documentation that the appropriate
easements for drainage and utilities have been granted by 2020 Salem
Court in favor of 2080 Salem Court.
2. Prior to filing of this Vacation Approval Resolution with Hennepin
County, the property owners of 2 0 2 0 and 2 0 8 0 Sa 1 em Court sha 11 grant
to the City a new drainage and utility easement 5' either side of the
recently created mutual lot boundary.
• Adopted by City Council of the City of Orono, Minnesota at a
regular meeting held February 9, 1987.
