The rationale behind this change is the realization that fill resulting from housing projects (e.g. deck construction) is only considered wetland fill under the Wetland Conservation Act(WCA) and the District's Wetland Protection Rule if the deck posts or pilings result in 1) bringing the wetland into a nonaquatic use, or 2) significantly alter the wetland's function and value according to the language in the WCA rules. Based on the information you have provided, it does not appear that the proposed project would result in either of these two scenarios, and therefore would not be regulated under the WCA and would not trigger the requirements of our Wetland Protection Rule. Your permit application was received on October 10, 2012, and it is currently incomplete. If the deck posts or pilings are proposed within the floodplain, a permit is required under the District's Floodplain Alteration Rule. In order for us to determine whether this permit is needed, please submit a site plan showing property lines, delineation of the work area, existing elevation contours of the work area, and the 100-year high water elevation (961'). All elevations must be reduced to NGVD (1929 datum). You can e-mail the survey directly to Brett or submit in hard copy form. Please feel free to call or e-mail either Brett or I with any questions.
