A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 78-1279(1), 78-1279(6) AND 78-1288
FIL� NO. 06-321�
WHEREAS, Todd Schaible and Michelle Schaible, husband and wife
(hereinafter "the applicants") are the owners of the property located at 1450 Chen•y Place
within the City of Orono (hereinafter the "City") and legally described as Lots 6 and 7
Block 4 and that part of the east half of Cherry Avenue vacated laying Northerly of
Westerly extension of the Southerly line of Lot 7 and Southerly of a line runnina from the
Northwest corner of said Lot 6 to the Northeast corner of Lot 5 Blocic �, all in Crystal
Bay View, Hennepin County, Minnesota (hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1279(1) to allow the portion
of the existin�house, porch, and deck within the 75 foot lakeshore setback to remain as
constructed in conjunction with a proposed t�vo-story addition; and
WHEREAS, the applicants have made applicatioii to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction
of an addition forward of the average lal:eshore setback; and
WHEREAS, the applicants have made application to the City of Orono
for variances to Orono Municipal Zonin� Code Section 78-1288 to allow 13 percent
hardcover in the 0-7� foot zone when no hardcover is allo«-ed and to al1o� 3� percent
hardcover in the 7� -250 foot zone «�hen 2� percent is allowed; and
WHEREAS, after due published notice and mailed notice in accordance
with Minnesota Statutes and the City of Orono Zonin� and Plannin� Codes, the Orono
Planning Conunission held a public hearina on Au�ust 21, 2006, at ���hich tiznes all
persons desirin� to be heard conceinina this application were given the opportunity to
speak thereon.

FINDTNGS
1. This application«�as reviewed as Zonin� File #06-3215.
2. The property is located in the LR-1B, Zonin� District which requires a
izlinimum lot area of one acre and a miilimum lot width of 100 feet.
3. The Plaiulin� Commission reviewed this application oi1 Au�ust 21, 2006
and on a vote of reconunended approval of the variance, based on the
following findings:
a. The portion the porch and deck within the 0 to 7� foot zone were
e;unstructcd iti 1 CJ c�1. �VV�111C t�lZ survey ai�d �lans that were part �f the
permit application clearly showed the porch and decic encroaching into
this setbacl:the permit was still issued.
b. There is no place to construct an addition without an avera�e lakeshore
setback variance as the entire house is located for���ard of the avera�e
lakeshnre sethacl;, The addation ��vill n�t adversely impact the
lakeshore vie��rs of the adjacent lakeshore properties.
c. The addition will update the floor plan of the house and allow
reasonable use of the property.
d. The amount of hardcover on the site will be substantially reduced as a
result of the proposed removals.
4. The City Council has considered this application includina the findin�s
and recommendation of the Plaruzin� Commission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
�. The City Council finds that the conditions existin� on this property are
peculiar to it and do not apply �enerally to other property in this zoninQ
district; that granting the variance �vould not adversely affect traffic
conditions, li�ht; air zlor pose a fire hazard or other danaer to neiQhborin�
property; would not merely serve as a convenience to the applicants, but is
neces�ary ta alleviate a demonstrable hardship or difficult}-; is necessar�� to

preserve a substantial property right of the applicants; and would be in
keepin� with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLIISIONS, ORDER AND CONDITIO?�TS
Based upon the above findings, the Orono City Council hereby �rauts variances to
Orono Muilicipal Zonin� Code Sections 78-1279(1), 78-1279(6) and 78-1288 to allow
construction of an addition, subject to the followin� conditions:
1. Council approval is based oil the site plan submitted by the applicants and
annotated by City staff; attacl�ed to this Resolution as E�hibit A. Any
amendments to the site plan which are not in conformity with City codes will
require further Plannin� Coirunission and City Council review.
2. Hardcover in the 0-75' zone shall be reduced to 951 s.f. or 13 % (including steps
to the lakej. Hardcover in the 75-25G' zone shall be limited to 6,2�6 s.f. or 3�%
per the proposed plan and hardcover allowance summary attached to this
Resolution as Exhibit B. Applicants are advised that aily future requests to
increase hardcover or chan�e the nature of existing/approved hardcover shall
require City appro�°al, and increases in hardcover will not liI`ely be approved
without concurrent reduction in exisiin�hardcover.
3. Applicants shall remove a?1 plastic o: fabric liner material from the decorative
landscape beds oz7 the property to ensure their pernleability as non-hardcover
surfaces.
�. Required reinovals of structure and hardcovei• sl�all be completed before the
addition is occupied.
5. Authorities �ranted by this resolution run with tlle property not witl� the
applicants, but are pennissive onlv and must be e�ercised by obtainin� a buildi�lQ
permit for the new construction before September 11, 2007. Should the
applicants fail to e.ither obtain a buildina pernit o� to receive a rene«�al of the
variance ��-ithin the year deadline it sha11 be necessary to file a ne�� application
��-ith the �itv.

7. The undersi�ned applicants have read, understand and hereby a�ree to the terms
of this resolution and on behalf of the applicants and the applicants' heirs,
