A RESOLIITION APPROVING A
METES AND BOUNDS SIIBDIVISION
OF A LOT LINE RF.ARRA�NGEMENT FOR
WARD RRUEGER
FILE NO. 1076
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; ancl
WHEREAS, the City Council of the City of Orono (hereinafter
"City Council") has adopted subdivision regulations for the orderly,
economic and safe development of land within the City; and
WH�3RSAS, the City Council has considered the application for
a subdivision by Ward Krueger (hereinafter "the subdivider") of
properties Yegally described as follows:
Lots 3, 4, and 5, Block 1, HoI1y Acres 2nd Addition, Hennepin
County, Minnesota, (hereinafter "the property"); and
�, WHEREAS, the City CounciY has approved the following
variances to performance standards of the Zoning Code:
Tract 3, Parcels E and F: Variance to Section 10.28, Subdivision .
5 (B) to all.ow a lot width of 165' and frontage only to a private
road where 200' of width and frontage on a pubYic road is
requi�ed. �

WHEREAS, the subdivider has compYeted alY requirements of
the City for metes and bounds subdivision for division and combination
purposes. .
NOW, THEREFORE, Bl: IT RESOLVED, that the City CounciY of the
City of Orono hereby approves the metes and bounds division of a lot
line rearrangement for Ward Rrueger as shown on the Certificate of
Survey by Gary L. Gabriel dated October lOth, 1986 and attached to
this resolution as Exhibit A, subject to the foYlowing conditions:
1. Upon approval of the subdivision by the City Council of
Orono, the owner of Parcels A, B, C, D, E, and F as described in
the Certificate of Survey referenced above must apply to the City
for legal combination for tax purposes as fo1 lows:
A) Parcel A must be combined with Parcel B.
• B) Parcel C must be combined with Parcel D.
C) Parcel E must be combined with Parcel F.

2. The aforesaid division sha1 �. not be filed by the City of
Orono with the Hennepin County Recorders Office untiY such time
that the applicant provides documentation that the property is
included as a participant in the covenants of the HoY ly Acres
Homeowners Association.
3. The aforesaid division as shown on the attached Certificate
of Survey sha�.Y be f i led by the City of Orono with the Hennepin
County Recorder's office on or before July 12, 1987 together with
a certified original copy of this resolution.
The approval granted by this resolution shalY expire if the
division has not been filed by the date specified above. In that
event, it will be necessary to file a new appYication with the City of
Orono for subdivision review.
Adopted by the City Council of Orono, Minnesota, this 12th
day of January, 1987.
