A CONDITIONAL IISE PERMIT
PER M[INICIPAL ZONING CODE
SECTION 10.20, SOBDIVISION 3 (D) .

WHEREAS, the City of Orono (hereinafter "the applicant") is
the owner of the property located at 2345 Blaine Avenue within the
City of Orono (hereinafter "City") and IegalYy described as follows:
That part of Lot 5, Block 9, Townsite of Langdon Park, Hennepin
County, Minnesota, described as follows: Beginning at a point on
the East line of said lot distant 495 feet North of the Southeast
corner of said lot: thence West 132 feet parallel with the South
line of said lot; thence South 200 feet parallel with said East
Yine; thence East 132 feet parallel with said South line to said
East �.ine; thence North 200 feet along said East line to the
point of beginning (hereinafter "property"); and
WHEREAS, the applicant has applied to the City of Orono for
a conditional use permit to permit the installation of an emergency
_ • preparedness siren per Municipal Zoning Code Section 10.20 ,
Subdivision 3 (D).
NOW, THEREFORE, B$ IT RESOLVED by the City Counci 1 of Orono,
' Minnesota:
FINDINGS
l. This application was reviewed as Zoning File #1095.
2. The property is located in the LR-1C Single Family Lakeshore
Residential District.
3. On November 17, 1986, the Orono Planning Commission reviewed
the application as proposed and recommended approval based on the
following finding:
The proposed emergency preparedness siren W�11 be located at
least 50' from aYl neighboring residential property, lines,
. and will be located within the fenced boundaries of the City
� of Orono water plant property.
4. A public hearing was held on November 17, 1986 at which time
all interested members of the public were aYlowed to comment on
the proposal. There were no comments from the public.
• 5. The City Council has considered this appYication including
. the findings and recommendations of the PYanning Commission,
reports by staff and comments of the applicant and the effect of
the proposed use on the heaYth, safety and welfare of the
community.

6. The City Council finds that granting a conditionaY use permit
to allow the installation of an emergency preparedness siren w�1 i
not be detrimental to the health, safety or general welfare of
the public, would not adversely affect light, air nor pose a fire
hazard or other danger to neighboring properties, nor W�i1 it
depreciate surrounding property values and that the proposed
level of use of the property will be in keeping with the intent
and objectives of the Zoning Code and Comprehensive Plan of the
City.
CONCLIISIONS, ORDER AND CONDITIONS

Based upon one or more of the above findings, the Orono City
Council hereby grants a conditional use permit per Municipal Zoning
Code Section 10.20, Subdivision 3 (D) to permit the instal lation of an .
emergency prepareclness siren, subject to the fol lowing conditions:
• 1. Siren shall be instaYled within the fenced confines of the
municipal water plant property and shall be located at Ieast 50'
from al 1 nearby residential property lines.
2. Violation of or non-compliance with any of the terms and
conditions of this resolution shaY 1 constitute a violation of the
� zoning code, shal 1 automatically terminate any authority granted
herein, and shalY be punishable as a misdemeanor. .
Adopted by the Orono City CounciY on this 8th day of
December, 1986.
