BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#
AGREEMENT made this day of , 20_, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") ("Owners").
Recitals
1. A building permit application has been filed a
located at the ("Subject Property°), legally

2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, enqineerinq, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit # if
compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Jason,
The building permit will be ready to be issued up on Monday,June 22"d for the in-kind replacement of the boat house.
Per our conversation yesterday, the Minnehaha Creek Watershed District (MCWD) has not issued a permit for the lake
stairs and retaining walls. The landscaping contractor cannot begin work on the lake stairs and retaining walls without a
permit from the MCWD and a zoning permit from the City (application attached).
A copy of the survey or certified site plan must be submitted with the zoning permit application showing the proposed
exterior/landscaping improvements i.e. patios, grading, sidewalks, retaining walis, etc. The plan must also include the
name of the individual who is performing the work.

We have an existing MCWD permit for 1410 Cherry Ave that the boathouse replacement would be covered by.
Permit#14-467.
Please see the forwarded email below from Terrance at MCWD. The replacement of the in-kind boathouse
does not require additional District permitting. However, prior to the landscaper installing the stone steps to
the dock, they will need to apply for a floodplain alteration permit.

Attached you will find the original project survey that we have on record. Based upon the most recent survey you sent
today, it appears the stairs from the boat house will be in the floodplain of Lake Minnetonka (931.5'). If this is the case,
the project will require a floodplain alternation permit (see attached).An in kind replacement of the existing boat house
does not require additional District permitting. However, if the location or dimensions of the boat house change (in
comparison to the attached plans), please let us know as different District rules may apply. If the boat house dimensions
have changed, please provide a survey showing what modifications to the existing project are proposed and where they
will take place. Please show all erosion control measures that you are planning on installing as well. If you have any

Dear Mr. Hink:
This letter is being sent to discuss our typical engineered section for the proposed boulder retaining walls
at the 1410 Cherry Place in Orono, Minnesota. This design is based: a Landscape Plan prepared by W
Landscapes dated October 25, 2014; a Certificate of Survey far the property prepared by Gronberg and
Associates dated October 27, 2014; and a site layout plan provided by you on October 31, 2014.
There are several retaining walls]ocated on the back/lake side of the house. They vary in exposed height
from about 3 feet to 1 foot. Included is a two-tiered retaining wall section with a total height of
approximately 6 feet. A minimum wall batter/setback of 8° (�1 inches/vertical foot) should be used.
Slopes as noted below will be present at the top and bottom of the walls. No groundwater or other
surcharge loads have been designed for the walls. If site conditions vary from what is shown on the
Typical Section, please call me to discuss other options.
Refer to industry standard practice references for installation information, specifications, and details.
- Boulders shall be placed to avoid continuous joint planes in vertical directions.
- Each stone shall bear on two or more rocks below it with good flat-to-flat contact.
- Compact any structural fill place behind the drainage zone to 95°Io standard proctor.
- Insta]] woven landscape fabric behind the stone to limit soil migration through the wall face.
- Optional drainage stone shall consist of clean 3/4" to ].5" crushed stone
The design of the wall system assumes the following:
- Soil conditions: Sandy Si1tlClay, friction angle= 30.0 degrees, unit weight of 120.0 lb/ft3
- Allowable soil bearing capacity=2,000 psf

On May 20, 2015 the City received a building permit application for retaining walls and in-kind replacement of a boat house.
Staff conducted a preliminary review based on the information provided and recommends the following items be submitted
or revised in order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. The City Engineer has reviewed the survey and made the following comments. Please provide
two copies of an updated, full size certificate of survey which meets all of the City's survey standards (enclosed)
addressing the comments below.
a. Top wall and bottom wall elevations, as required by the City's survey/site plan standards and are not provided for
the retaining wall next to the lake(P). Walls over 4 ft must be designed by a professional engineer.
b. During this review it was noted that retaining wall (N) is shown to be 7.9 ft tall and will also require an engineered
design.
2. olution. The property owners need to come to City Hall and sign the resolution approving the variance for the
retaining walls within 75 feet of the ordinary high water level. They should bring along a driver's license or another
form of identification for our staff to notarize their signatures. Office hours during the summer are Monday —
Thursday 7:30 am to 5 pm and Friday 7:30 to 11:30 am. The resolution must be signed before we will issue the
building permit.
3. Escrow& Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an
escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-
pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City
Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is $2,500,
an updated escrow agreement is enclosed. The property owner must sign the updated escrow agreement and return
the agreement to us. No additional escrow money is needed at this time.
4. Separate City Permits Required for:
a. 2oning Permit. Prior to the commencement of � exterior/landscaping improvements, i.e. patios, grading,
sidewalks, retaining walls, etc., not currently shown on the survev will require a Zoning Permit.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact the
MCWD directly at 952-471-0590 regarding your project. Please note,the City of Orono will not issue a building permit without
a copy of MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of their
permitting requirements. The above information is required in order for the plan review to continue. Please feel free to
