On September 29, 2014 the City received a building permit application for a new single family home. Your application is
incomplete. The following items must be submitted or revised in order for your application to be considered complete and
for the plan review to continue:
1. Certificate of Survey. Please provide two copies of an updated,full size certificate of survey which meets all of the
City's survey standards(enclosed) specifically clarifying:
a. Please clarify what improvements are existing and what if anything is being proposed within 75' of the
ordinary high water level (OHWL).
b. There is grading shown in the 75' setback. Please note, earth movement greater than 10 cubic yards
within 75' of the OHWL requires a City Council approved Conditional Use Permit.
c. Average Lakeshore Setback. The survey should show the lakeward most point of the homes on both sides
of the subject property. The line to the house addressed as 1430 Cherry Place does not meet the house,
• please adjust the line or add the missing structure the line intersects with.
d. Show top and bottom of wall elevations for all walls and specifically those that are forward of the average
lakeshore setback.
2. Structural Coverage. The property is over the allowed 15% structural coverage. It appears the pergola which is
structural coverage was not included in the submitted calculations. Please adjust and resubmit.
3. Engineered Walls. Retaining walls over 4 feet in height must be engineered. Please provide engineering for the
proposed retaining walls.
4. Escrow& Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of
an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for
out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance
with City Code Chapter 79 relating to erosion control and stormwater.The required escrow amount for this project
is$2,500. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a
check for$2,500.
The above information is required in order for the plan review to continue. Also, we will need a demolition permit
application(copy attached)submitted with the all the supporting documentation for our review. Please feel free to contact

Dear Mr. Hink:
This letter is being sent to discuss our typical engineered section for the proposed boulder retaining walls
at the 1410 Cherry Place in Orono, Minnesota. This design is based: a Landscape Plan prepared by W
Landscapes dated October 25, 2014; a Certificate of Survey for the property prepared by Gronberg and
Associates dated October 27, 2014; and a site layout plan provided by you on October 31, 2014.
There are several retaining walls located on the back/lake side of the house. They vary in exposed height
from about 3 feet to 1 foot. Included is a two-tiered retaining wall section with a total height of
approximately 6 feet. A minimum wall batter/setback of 8° (�1 inches/vertical foot) should be used.
Slopes as noted below will be present at the top and bottom of the walls. No groundwater or other
surcharge loads have been designed for the walls. If site conditions vary from what is shown on the
Typical Section,please call me to discuss other options.
Refer to industry standard practice references for installation information, specifications, and details.
- Boulders shall be placed to avoid continuous joint planes in vertical directions.
- Each stone shall bear on two or more rocks below it with good flat-to-flat contact.
- Compact any structural fill place behind the drainage zone to 95% standard proctor.
- Install woven landscape fabric behind the stone to limit soil migration through the wall face.
- Optional drainage stone shall consist of clean 3/4" to 1.5"crushed stone
The design of the wall system assumes the following:
- Soil conditions: Sandy SilUClay, friction angle=30.0 degrees, unit weight of 120.0 lb/ft3
- Allowable soil bearing capacity =2,000 psf
- No external surcharge loading behind walls
- Slope at bottom of wall = 10:1; Slope at top= 10:1

Dear Mr. Cookas:
This revised letter is being sent to discuss our typical engineered section for the proposed boulder
retaining walls at the 1410 Cherry Place in Orono, Minnesota. This design is based: a Landscape Plan
prepared by W Landscapes dated October 25, 2014; a Certificate of Survey for the property prepared by
Gronberg and Associates dated October 27, 2014; and a site layout plan provided by you on October 31,
2014. Additional written information was provided by you on December 22, 2015, regarding construction
means and methods.
There are several retaining walls located on the back/lake side of the house. They vary in exposed height
from about 6 feet to 1 foot. Included is a two-tiered retaining wall section with a total height of
approximately 11 feet (5' bottom wall, 6' upper wall, 2.5' distance between the walls). A minimum wall
batter/setback of 8° (�1 inches/vertical foot) should be used. Slopes as noted below will be present at the
top and bottom of the walls. No groundwater or other surcharge loads have been designed for the walls.
If site conditions vary from what is shown on the Typical Section, please call me to discuss other options.
Refer to industry standard practice references for installation information, specifications, and details.
- Boulders shall be placed to avoid continuous joint planes in vertical directions.
- Each stone shall bear on two or more rocks below it with good flat-to-flat contact.
- Compact any structural fill place behind the drainage zone to 95%standard proctor.
- Install woven landscape fabric behind the stone to limit soil migration through the wall face.
- Optional drainage stone shall consist of clean 3/4" to 1.5"crushed stone
The design of the wall system assumes the following:
- Soil conditions: Sandy SilUClay, friction angle = 30.0 degrees, unit weight of 120.0 Ib/ft3
- Allowable soil bearing capacity = 2,000 psf
- No external surcharge loading behind walls
- Slope at bottom of wall = 10:1; Slope at top = 10:1
- Minimum embedment depth = 6"

TERMS AND CONDITIONS
This WALL DESIGN and ensuing recommendations is expressly made subject to the following terms and conditions
to which all persons that receive and rely thereon agree:
1. Standard of Service—Services performed by ENGINEER under this agreement shall be performed in a manner
consistent with the skill and care ordinarily used by members of the engineering profession practicing under similar
conditions at the time and in the locality the services are performed.
• Client recognizes that interpretations and recommendations of ENGINEER are based solely on the
information available to the company.
• ENGINEER will be responsible for those interpretations and recommendations, but shall not be responsible
for the interpretation by others of the information developed
• Services provided reflect the professional judgment of ENGINEER, to the best of ENGINEER's knowledge,
information, and belief as of the date hereof.
• No other warranty or guarantee, express or implied, is made.
2. Said design is based entirely on and expressly limited by the scope of services ENGINEER has been employed by
Client to perform and as described in WALL PROVISIONS and LIMITATIONS.
3. If the ENGINEER is hired for any construction phase services or site visits, it is understood that the Contractor, not
the ENGINEER, is responsible for the construction of the project, and that ENGINEER is not responsible for the acts
or omissions of any contractor,subcontractor or material supplier;for safety precautions, programs or enforcement;
or for construction means, methods, techniques, sequences and procedures employed by the Contractor.
4. OWNERSHIP OF DOCUMENTS:All reports,field data, field notes, calculations, estimates and other documents
(`reports') prepared by Engineer, as instruments of service, shall remain the property of Engineer. Client agrees that
all reports furnished to Client or his agents,which are not paid for,will be returned upon demand and will not be used
by Client for any purpose whatever. Engineer will retain all pertinent records relating to the services performed for a
period of five years following submission of the report,during which period the records will be made available to
Client at all reasonable times.
5. TERMINATION: This agreement may be terminated by either party by written notice. In the event of termination,
ENGINEER shall be paid for services performed and expenses incurred up to the termination notice date. Neither
Client not ENGINEER may delegate,assign, sublet or transfer his/her duties or interest in this Agreement without the
written consent of the other party.
6. To the fullest extent permitted by law, Client and ENGINEER (1)waive against each other, and the other's
employees, officers, directors, agents, insurers, partners, and consultants, any and all claims for or entitlement to
special, incidental, indirect, or consequential damages arising out of, resulting from, or in any way related to this wall
design and written report, (2) agree that ENGINEER's total liability to Client shall be limited to the total amount of
compensation received by ENGINEER and (3) if an action is brought against the ENGINEER and the ENGINEER
prevails, ENGINEER shall be entitled to recover costs and expenses, including reasonable attorneys'fees and costs.
