Christine,
I have reviewed the application for 1390 Cherry Place where they are proposing a stair and retaining wall replacement. I
have also spoken with the contractor(Tim Lovett) and my understanding of the project is they are going to leave in place
the existing staircase and construct new stairs above the existing staircase. The contractor is also going to remove and
replace an existing 5' high retaining wall with a wall under 4 feet in height. The retaining wall work will be done mainly
by hand, but there is a possibility a small excavator will be required.
Since the proposed wall is going to be under 4' in height and they are not removing the existing stairs I do not see
additional requirements needed per City Code for the permit. I do have some concerns the applicant should consider
prior to construction:
1. If an excavator is required,the disturbance to the existing ground must be minimized to avoid erosion and slope
destabilization.
2. The wall being proposed to be under 4' in height and by code does not need engineering plans or approval. I
would highly recommend the applicant consult with an engineer to determine slope stability and soi►strength
before installation of the proposed wall.
3. Any disturbance to the slope must be revegetated and stabilized as soon as possible after disturbance to avoid
additional erosion or bank destabilization.
4. Erosion control shall be installed as shown on the approved partial plan printout.

The zoning application form is attached. Fee is $50; escrow is $2000. Both are due at the time of the permit issuance.
Please submit survey, site photos and stair plans. If you'll be doing any grading for the new in-kind walls please calculate
the cubic yards. Less than 10 cy within 75'of the lake is allowed without a CUP. An in-kind replacement of the walls and
stairs (same footprint) will not require variance for hardcover.
I'll have Willie call you to set up a meeting with you on site to look at the existing stairs and discuss your questions before
you put your application together. I have 612-226-8344 for your number. Is this correct?
