SECTION 78-966 (A)

WI3EREAS, Tei7-y J. Blount and Gretchen Blount, husband and wife
(hereinafter "the applicants") are the o���ners of the property located at 1390 Cheny Place
within the City of Orono (hereinafter the "City") and legally described as follo���s:
That part of Govenunent Lots 4 and 5, Section 8, Township 117 North, Range 23
West of the 5`�' Principal Meridian, described as follows: Be�inning at the
Southwest corner of Lot 7, Blocic 11, Sa�a Hill Revised; thence East along the
South line of said Lot 7 to the shore of North An��, Lake Mitmetonl.a; thence
southerly along the shore of Lake Miiuzetoi�l:a 57.0 feet, more or less to the
Northeast conler of Lot l, Blocl: 4, "Ciystal Bay View"; thence West along the
North line of said Lot 1 to the I�'orthwest conler of said Lot 1; thence northerly to
the place of begiruzing; AND ALSO Lot 7, Blocic 1 l, Saga Hill Revise.d.
(hereillafter the "property"); and
WHEIZEAS, the applicants have made application to the City of Orono
for a conditional use pennit per Orono Municipal Zoning Code Section 78-966 (A) to
pennit land alteratioi7s within 75' of the QHWL of Lalce Minnetonlca eonsistiil� of
replacement of the existin�railroad tie retaining wall with two, 4' tall boulder walls and a
planting plan.

1. T11is application was revie�ved as Zonin� File 04-?969.
2. The property is located in the LR — 1B, Oi1e Family Lakeshore Residential
District which requires a mininzuni lot area of l.0 acres and a ininimlim lot
width of 140' at tl�e shoreline and 7>' setbacic.

3. The Plaiuling Commission reviewed this application at a public hearing
held on June 20, ?005 and recommended approval of the conditional use
pei-�nit request based on the following findings:
a. The e�istin�railroad tie retaining wall is in need of repair.
b. The City Engineer has reviewed and approved the proposed wall
replacement and planting plan.
c. No negative impacts will result when viewed from the lalce.
4. The City Council has considered this application including the findin�s
and recommendation of the Planning Commission, reports by City staff
cominents by the applicants and the public, and the effect of the proposed
conditional use pennit oi1 the healtl�, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that �-anting the conditional use peiznit would not adversely affect
traffic conditions, light, air nor pose a fire hazard or other danger to
neigllboring property; would not merely serve as a convenience to the
applicants, but is necessary to alleviate a demonstrable hardship or
difficulty; is necessary to preserve a substantial propei-ty right of the
applicants; and would be in lceeping with the spirit and intent of the
Zonin� Code and Coinprehensive Plan of the City.

�-ants a conditional Lise pernlit p�r Jrono Municipal Zonin� Code Section 78-966 (A) to
pennit land alterations within 7�' of the OHWL of Lake 'Vliruletonka consisting of
replacement of the e�istin� railroad tie retaining �vall with two, 4' tall boulder walls and a
plantin�plan, subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and
aiulotated by City staff, attached to this Resolution as Exhibit A. Any

aniendulents to the site plan which are not in conforniity with City codes will
require fiuther Plamiing Commission and City Council review.
2. Applicants shall remove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their pernleability as non-hardcover
surfaces.
3. Authorities granted by this resolution run with the property not with the
applicants, but are pernlissive only and mttst be exercised by obtaining a building
pernlit for the new constniction within oue year of the date of Council approval,
or the conditional use pernlit�vill expire on that date (June 27, 2006).
4. Violation of or non-compliance with any of the ternZs and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
tenninate any authority �ranted herein, and shall be punishable as a misdetneanor.
5. The uiidersi�zed applicants have read, understand and hereby agree to the tenns
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.
Adopted by the Orono City Council on the ?7"' day of June, 2005.
