In finalizing my review for your building permit it came to my attention that the width of the property is substandard and
requires approval of a lot width variance by the City Council. You were notified of and acknowledged this on 9/21/2012
when you signed the Zoning Disclosure form as part of the demolition permit review.
The City Council will be reviewing and (hopefully) approving a City Code amendment at their October 8th meeting which
would allow administrative approval to be granted to lots in this situation. I have attached the staff report from the
September 17th planning commission meeting which contains details about the proposed City Code amendment. However,
in the meantime I cannot issue your building permit administratively. I apologize for the timing of this notification and
this is the only remaining outstanding issue.
I will be out of the office for the remainder of this afternoon and will return tomorrow AM.

I have reviewed the proposed survey for the new house at 1370 Cherry Place and have the following comments:
• The proposed retaining wall needs to show the top and bottom elevation along the wall and at the tallest
location. Any wall over 4' in height or a tiered wall not separated by 2x the difference of the tallest wall (as
measured from the face of the upper wall to the back of the lower wall) needs to be engineered by a registered
professional engineer.
• The grading needs to be maintained on the property. The proposed plan shows water being directed toward the
home/garage to the south.
• The plan needs to include silt fence location.
• While the grading plan includes a lot of areas with 3:1 slopes surrounding the house. It has been my experience
the homeowners do not like the steep slopes (tough to maintain/mow) and will instead add additional walls not
shown on the approved plan. If additional walls are installed during the restoration, you will need to come back
to amend the plan prior to installation of the walls. This will adjust the hardcover calculations and may result in
the home being out of compliance with hardcover regulations.
• The grading is shown to end abruptly at the 75' setback line. It again has been my experience that this tends to
not take place. If additional grading occurs within the 0-75' zone, you will be required to apply for additional
permits and potentially may have to go through a variance procedure.
• Is any work being done to replace the existing stairs to the boat house? Many times this is not shown to be
included in the project, but is then added later. If additional work is to take place on the stairs,you will need to
come back for a plan amendment prior to the work taking place.

Hey Jesse,
I have received your comments concerning your review of the lot survey for the above referenced lot and, on
behalf of the property owner, offer the following:
1) Owner desires to remove wall from plan. (Survey will be updated)
2) In regards to maintaining drainage on parcel, the drainage is intentionally conveyed to the south side -
sideyard. As depicted on the survey, there is an inlet tile at the sideyard low point that was installed by the city
to benefit this lot. This tile was installed by the city to alleviate localized flooding caused by runoff from the
public street and grading modifications done by the property to the south. As shown on the surveys, the
proposed condition is not changed from that of the existing. This grading (both existing and proposed) is also
as such to protect and provide drainage away from the garage, which has a finish floor lower than the adjacent
street. (No changes to survey)
3)Silt fence will be added to the survey. (Survey will be updated)
4)Your comment concerning slopes, additional walls and hardcover requirements is noted. (No plan revisions).
5)Your comment concerning matching the grades at the 75' setback is noted. Any contour softening will be
outside of the setback. (No changes to survey)
6)No work is being performed on boathouse or steps to lake at this time. (No survey revisions)
I will have the survey revised to show the wall removed and silt fence added. Once you receive please call me
if you have any concerns. We are hoping to have permit in-hand this week to begin construction.

certain rights which may have accrued to the property by virtue of the continued existence of that building,
