Andrew,
I have reviewed the as-built survey for 3925 Cherry Avenue. The survey shows a tiered wall on the east side of the
house that has a height in excess of 4'. A wall evaluation has been provided by Schimnowski Engineers that indicates
that the wall appears to be structurally stable and in general conformance with boulder retaining wall and construction
industry standards. The evaluation does recommend that gutters and downspouts be installed and maintained on the
house to direct roof runoff away from the wall. At this time there are no gutters on the house, however,there are no
signs of erosion or drainage concerns at this time. Let me know if you have questions.

Dear Mr. Kuka:
This letter is being sent per your request for an evaluation of the boulder retaining wall construction at the
3925 Cherry Avenue project in Orono,Minnesota. This evaluation is based on site observation I made
during a site visit performed on August 18,2014(see attached photos).
The construction of the retaining walls appears to be structurally stable and in general conformance with
boulder retaining wall and construction industry standards. The walls were constructed with boulders of
sufficient size and setback. Other typical construction details such as use of drainage elements and filter
fabric also appeared to be followed correctly. As is normal for boulder retaining walls of this type, some
wall movement and soil settlement should be expected.
I recommend that gutters and downspouts be installed and maintained on the house in order to direct the
roof runoff away from the retaining wall. Concentrated areas of surface water should also be directed
away from the walls.
This evaluation was performed using the design guidelines presented in the third edition of the"Design
Manual for Segmental Retaining Walls" (DMSRW)published by NCMA in 2009. If soil conditions,
proposed layouts,or other design parameters vary from that assumed a revised analysis might be needed.

This report is expressly made subject to the following terms and conditions to which all persons that receive and rely
thereon agree:
1.The Engineers services shall be perfocmed with the skill and care ordinarily used by members of the engineering
profession pracdcing under similar conditions at the same dme and in the same locality and applies only to facts that
are within Engineer's knowledge or could reasonably have been ascertained by ENGINEER.
• Our observarions were non-destructive,and limited to those portions of the facility that could be visually
examined without excavation,removing surface finishes,disassembling equipment,or removing finishes,
furnishings and equipment.
• Our scope of services did not include an exhaustive technical invesdgation.No material sampling,analytic
tests,precise measurements or engineering calcularions were performed.
• We did not determine whether the facility and its operadon or use conform to any building codes,or
reguladons,or restrictions that may be enforced within the jurisdiction.
• Probable cost estimates figures,if provided,are based on statistical construction records,past project
experience,and judgment.The actual cost will vary based on economic and bidding conditions.We
recommend that the actual be determined by obtaining compeddve bids.
2.The report is not to be construed as guarantees or warranties of the condition of the buildings and grounds.
3. Said Report reflects and is an expression of the professional judgment of ENGINEER.
4. Said Report is given as to the best of Engineer's knowledge,information,and belief as of the date hereof.
5.Said Report is based entirely on and expressly limited by the scope of services ENGINEER has been eraployed by
Client to perform.
6.To the fullest extent permitted by law,Client and Engineer(1)waive against each other,and the other's
employees,officers,directors,agents,insurers,partners,and consultants,any and all claims for or entitlement to
special,incidental,indirect,or consequential damages arising out of,resulting from,or in any way related to this
report,and(2)agree that Engineer's total liability to Client shall be limited to the total amount of compensation
received by Engineer.
7.The parties acknowledge that Engineer's scope of services does not include any services related to Molds or
Hazardous Environmental Condition(the presence of asbestos,PCBs,petroleum,hazardous substances or waste,
and radioactive materials).If,however,during the inspection,we knowingly encounter such substances,we will
notify you of the presence of these substances without accepting any liability whatsoever for any damage or harm
caused by the substances.It is yow responsibility to determine if further testing is required and to retain an
independent,qualified professional to perform such tests.

City Engineer, Jesse Struve, has reviewed the as-built survey dated 12-4-12 and visited the property addressed
3925 Cherry Place, his comments are below. Please address his concerns and submit the required information
and an updated survey before Thursday, September 12, 2013. The property remains in violation until all
outstanding issues are resolved.

1. Trees and landscaping were installed along Minnie Avenue which may encroach into the City's right of
way (ROW). The property line needs to be marked to verify if there is an encroachment. Any encroachment
needs to be removed.
2. A swale was supposed to be constructed through the south side of the property, but it was not installed. The
grading should be evaluated by the surveyor to assure water is not being directed to the structure to the south.
Additional contours should be shown and the location of the building to the south to determine if water is being
directed to an adjacent structure.
3. The retaining walls on the east side of the house do not meet the spacing requirements for a tiered wall
system and will require engineered plans and specifications by a registered professional engineer.

City Engineer, Jesse Struve, has reviewed the as-built survey dated 12-4-12 and visited the property addressed
3925 Cherry Place, his comments are below. Please address his concerns and submit the required information
and an updated survey before Thursday, September 12, 2013. The property remains in violation until all
outstanding issues are resolved.
1. Trees and landscaping were installed along Minnie Avenue which may encroach into the City's right of
way (ROW). The property line needs to be marked to verify if there is an encroachment. Any encroachment
needs to be removed.
2. A swale was supposed to be constructed through the south side of the property, but it was not installed. The
grading should be evaluated by the surveyor to assure water is not being directed to the structure to the south.
Additional contours should be shown and the location of the building to the south to determine if water is being
directed to an adjacent structure.
3. The retaining walls on the east side of the house do not meet the spacing requirements for a tiered wall
system and will require engineered plans and specifications by a registered professional engineer.

Sec. 78-967. Exception.
(a) The requirements of section 78-966 are not intended to govern the following land alteration
activities:
(�) Normal and customary grading in the area of an existing or a newly constructed
building, or the grading of the driveway serving such building.
�2) Any earth movement under 500 cubic yards which does not adversely impact the
existing drainage.
�3) Grading, filling or excavating of ten cubic yards or less within the shore setback zone
of all lakes enumerated in article IX of this chapter.
�b) Such grading and earth movement shall be subject to approval by the building inspector at
the time of issuance of a building permit, provided that a plan showing proper drainage and
protection of adjoining property has been submitted. Where such earth movement is not
being performed in conjunction with a building permit, a separate land alteration permit shall
be required. Any unusual land alterations, including earth filling, removal or grading,
proposed by a builder shall be subject to a conditional use permit as provided for in this
chapter. The following land alterations shall be considered as unusual land alterations:
��) All excavations for foundations in excess of 12 feet average depth if any amount of
the excess material removed below 12 feet depth is to be stockpiled on the site.
(2) Any additional fill brought on site in excess of 500 cubic yards, except for fill required
to raise grade for adequate frost footing protection, the intent being that structures
shall not be artificially raised above the preexisting surrounding topography.
�3) Grading or alterations that would propose any changes in elevations within five feet of
adjacent residential lot lines except for drainage swales and ditches.
��) The building inspector shall have the authority to refer any requests for land alteration
permits to the city council for review and approval in instances where the land alteration
appears to potentially create negative impacts or be not in keeping with the goals and
policies of the community management plan.

Sec. 86-68. Permit application; information required.
(a) The application for a construction permit shall include such information as may be required
by the city, which may vary between types of construction projects.
(b) Surveys required:
(�) Initial survey. Any building or general permit application for construction of a new
structure or expansion of an existing structure shall be accompanied by a certificate of
survey prepared by a Minnesota Registered Land Surveyor unless the building official
determines the construction project is exempt from this section. The certificate of
survey shall conform to the standards on file in the office of the building official.
�2) Foundation survey. A foundation survey shall be submitted to the city for review and
approval, unless exempted by the building o�cial, upon completion of the foundation
work for all buildings and all additions to buildings. The foundation survey, prepared
by a Minnesota Registered Land Surveyor, shall certify the lot dimensions; front, side,
rear, lakeshore, and wetland setbacks; and foundation elevation. A foundation survey
must be submitted before proceeding with framing or further construction. In lieu of a
survey a letter prepared by a Minnesota Registered Land Surveyor containing the
same information as a foundation survey may be submitted.
(3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land
Surveyor, shall be submitted to the city for review and approval upon the completion
of all buildings and all additions to buildings, unless exempted by the building official.
The as-built survey shall certify the final topography of the site; verify drainage
patterns; and provide hardcover calculations for lots in the Shoreland Overlay District.
An as-built survey must be approved before the issuance of a certificate of
occupancy. In the event that weather or other conditions prevent the completion of an
as-built survey at the time the Certificate of Occupancy is requested, applicant shall
provide a sufficient financial guarantee and establish an escrow agreement to ensure
completion of the as-built survey.

Our office previously sent you a letter dated August 7, 2013 regarding the code violations
� on the above referenced property and allowing you 14 days from that date to contact the

updated survey before Thursday,September 12,2013. The property remains in violation until all outstanding issues are
resolved.
1. Trees and landscaping were installed along Minnie Avenue which may encroach into the City's right of way
(ROW). The property line needs to be marked to verify if there is an encroachment. Any encroachment needs
to be removed.
2. A swale was supposed to be constructed through the south side of the property, but it was not installed. The
grading should be evaluated by the surveyor to assure water is not being directed to the structure to the south.
Additional contours should be shown and the location of the building to the south to determine if water is being
directed to an adjacent structure.
3. The retaining walls on the east side of the house do not meet the spacing requirements for a tiered wall system
and will require engineered plans and specifications by a registered professional engineer.

I went out to review the as-built survey for 3925 Cherry Ave and have the following concerns:
• The area does not have final grading complete or turf established.
• The silt fence and erosion control need to be reestablished until turf is installed or established. This needs to be
completed in the next 48 hrs.
• The tiered walls on the east side of the house are greater than 4' and do not meet the separation requirements
(2x the distance of the lower wall). Therefore the resident will need to have a registered professional engineer
review the wall installation and sign off on how they were installed.
• The driveway has changed drastically from what was approved and additional walls have been installed
throughout the property. They should submit new, as-bui!t hardcover calculations showing the updated
numbers.

A Temporary Certificate of Occupancy (TCO) was issued for the new home permit for 3925 Cherry Avenue on
January 15, 2013 with a list of requirements, specifically exterior landscaping requirements, to be completed by
June 1, 2013. A $10,000 escrow was collected by the City with the TCO to ensure completion of the exterior
work.
An as-built survey was submitted and our engineer performed a site inspection made on May 6, 2013. The
engineer noted the exterior work was not satisfactorily completed and on May 7, 2013 a list of outstanding
items was emailed to Todd Holmers & Dean lohnson. Attached is a copy of the TCO with conditions and the
email sent.
Recently City staff observed the unfinished site including an excessive amount of overgrown weeds. In short, it
does not appear that completion of the exterior work is underway... Please address the outstanding engineering
comments and submit an updated as-built survey; updated as-built hardcover calculations; and certification by a
Professional Engineer on the as-constructed retaining walls for our review. Please be aware your TCO approval
has expired, if the TCO requirements are not completed by July 15, 2013, the City will forward this matter to
the City Attorney to explore legal remedies.

I went out to review the as-built survey for 3925 Cherry Ave and have the following concerns:
• The area does not have final grading complete or turf established.
• The silt fence and erosion control need to be reestablished until turf is installed or established. This needs to be
completed in the next 48 hrs.
• The tiered walls on the east side of the house are greater than 4' and do not meet the separation requirements
(2x the distance of the lower wall). Therefore the resident will need to have a registered professional engineer
review the wall installation and sign off on how they were installed.
• The driveway has changed drastically from what was approved and additional walls have been installed
throughout the property. They should submit new,as-built hardcover calculations showing the updated
numbers.

I went out to review the as-built survey for 3925 Cherry Ave and have the following concerns:
• The area does not have final grading complete or turf established.
• The silt fence and erosion control need to be reestablished until turf is installed or established. This needs to be
completed in the next 48 hrs.
• The tiered walls on the east side of the house are greater than 4' and do not meet the separation requirements
(2x the distance of the lower wall). Therefore the resident will need to have a registered professional engineer
review the wall installation and sign off on how they were installed.
• The driveway has changed drastically from what was approved and additional walls have been installed
throughout the property. They should submit new, as-built hardcover calculations showing the updated
numbers.

A Temporary Certificate of Occupancy (TCO) was issued for the new home permit for 3925 Cherry Avenue on
January 15, 2013 with a list of requirements, specifically exterior landscaping requirements, to be completed by
June 1, 2013. A $10,000 escrow was collected by the City with the TCO to ensure completion of the exterior
work.

Recently City staff observed the unfinished site including an excessive amount of overgrown weeds. In short, it
does not appear that completion of the exterior work is underway... Please address the outstanding engineering
comments and submit an updated as-built survey; updated as-built hardcover calculations; and certification by a
Professional Engineer on the as-constructed retaining walls for our review. Please be aware your TCO approval
has expired, if the TCO requirements are not completed by July 15, 2013, the City will forward this matter to
the City Attorney to explore legal remedies.

I went out to review the as-built survey for 3925 Cherry Ave and have the following concerns:
• The area does not have final grading complete or turf established.
• The silt fence and erosion control need to be reestablished until turf is installed or established. This needs to be
completed in the next 48 hrs.
• The tiered walls on the east side of the house are greater than 4' and do not meet the separation requirements
(2x the distance of the lower wall). Therefore the resident will need to have a registered professional engineer
review the wall installation and sign off on how they were installed.
• The driveway has changed drastically from what was approved and additional walls have been installed
throughout the property. They should submit new, as-built hardcover calculations showing the updated
numbers.

An as-built survey, prepared by a Minnesota Registered Land Surveyor, shall be submitted to the city for review and
approval upon the completion of all buildings and all additions to buildings, unless exempted by the building
official. The as-built survey shall certify the final topography of the site; verify drainage patterns; and provide
hardcover calculations for lots in the Shoreland Overlay District. An as-built survey must be approved before the
issuance of a certificate of occupancy. In the event that weather or other conditions prevent the completion of an as-
built survey at the time the Certificate of Occupancy is requested, applicant shall provide a sufficient financial
guarantee and establish an escrow agreement to ensure completion of the as-built survey.
(Code 1984, § 12.02; Ord.No. 49 3rd series, § 1, 9-8-2008)
Due to winter weather conditions, the as-built survey cannot be approved, therefore in order to occupy the
home, a Temporary Certificate of Occupancy (TCO) is required. A TCO escrow agreement is attached. The
City currently holds a $2,500 escrow associated with the building permit. Submit to the City an additional
$7,500, for a total of$10,000 along with a signed copy of the TCO escrow agreement in order to remain in the
home.
The signed TCO escrow agreement and additional $7,500 must be received by noon on Monday, January 14,
2013, or this matter will be sent to our attorney for review and may result in criminal prosecution.

To follow up on my emaii to you on Friday, December 7, 2012, you should now be aware that according to
the 2006 International Residential Code (IRC) section R110 and City of Orono Code Section 86-37(4), it is
unlawful to occupy a home without a certificate of occupancy (CO). To begin the CO process, City Code
requires submittal and Citv EnQineer approval of an as-built survey prior to the issuance of a CO [City Code
Section 86-68]. Copies of R110 and City Code sections are attached.
As stated on your building permit #2012-00270, due to weather conditions, a temporary certificate of
occupancy (TCO) may be issued with a $10,000 escrow to be held until the exterior grading and
landscaping are finished. Please be advised, you have not received property authorization to occupy the
home and are doing so in violation of Orono and State building codes.
Attached is a temporary certificate of occupancy escrow agreement. Please read, sign and return the TCO
escrow agreement, with a check for $10,000 before Noon on Friday, December 21, 2012. Please be

Sec. 86-37. -Unlawful acts.
It is unlawful for any person to:
(1) Do any work without first obtaining a required permit from the city authorizing such work.
(2) Do any work beyond or outside the scope of a permit issued by the city.
(3) Do any work prior to obtaining a required inspection and approval from the city, including
failure to request any required inspection.
(4) Fail to comply with the terms or conditions of a permit issued by the city, including failure to
comply with all building or zoning requirements.
(5) Fail to compiy with any correction orders lawfully issued by the city when any work done is
found to be in violation of or noncompliance with permit requirements.
(6) Fail to stop or suspend work on any project or portion of a project in accordance with a lawfully
issued stop work order.
(7) Fail to pay any permit fee, inspection fee or reinspection fee.
(8) Fail to comply with the terms and conditions of any buiiding or zoning occupancy certificate.

Sec. 86-68. -Permit application; information required.
(a) The application for a construction permit shall include such information as may be required by the
city, which may vary between types of construction projects.
(b) Surveys required:
(1) Initral survey. Any building or general permit application for construction of a new structure or
expansion of an existing structure shall be accompanied by a certificate of survey prepared by
a Minnesota Registered Land Surveyor unless the building official determines the construction
project is exempt from this section. The certificate of survey shall conform to the standards on
file in the office of the building official.
(2) Foundafion survey. A foundation survey shall be submitted to the city for review and approval,
unless exempted by the building official, upon completion of the foundation work for all
buildings and all additions to buildings. The foundation survey, prepared by a Minnesota
Registered Land Surveyor, shall certify the lot dimensions; front, side, rear, lakeshore, and
wetland setbacks; and foundation elevation. A foundation survey must be submitted before
proceeding with framing or further construction. In lieu of a survey a letter prepared by a
Minnesota Registered Land Surveyor containing the same information as a foundation survey
may be submitted.
(3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land Surveyor, shall

AGREEMENT made this day of , 20 , by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and Real Assets, LLC /Todd Holmers ("Owners").
Recitais
1. Construction of the new residence located at 3925 Cherry Avenue the ("Subject
Property"), legally described as Lots 1 and 2, and the East 10 feet of Lot 21, Hickory Hill
in Orono, Hennepin County Minnesota, is the subject of building permit application
number#2012-00270 has been completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or wili incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2012-00270 if compliance with the approved building permit is not
accomplished. '
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when the review has been compieted and written notification is received from the Owners
requesting the funds.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

The as-built survey for 3925 Cherry Avenue was received today, thank you. Even though the building
inspector performed the final inspection, a final certificate of occupancy has not been issued.
According to the 2006 International Residential Code (IBC) section R110 and City of Orono Code Section 86-
37(4), it is unlawful to occupy a home without a certificate of occupancy. City Code requires submittal and
approval of an as-built survey prior to the issuance of a certificate of occupancy (City Code Section 86_681.
Copy of R110 is attached and links have been provided for the City Code Sections.
