There are questions sbout the division. The `�°
ne��ly created lot (Tract B) is low with a drain-
aqe area flowing throu�h a.t. The soil needs to
be evaluate8 before a building can be constructed `
on it. The lots r�eet the required half•acre
area but the lake frontage is only 50' , half o�
the required width. There was no previous
resolution of approval and the Cit� did not
rec�uest any flowage easement.
I recommend that the Council refer the r�etter
hack to the Planning Commission due to the
length of time this has been pending and the
changes in procedure and policy since 1975. You
may wish to require a new application and a new f.ee.

Mr. Singer referred the Cor.tmission to the March

The Zoning Administrator replied the payment of
the park dedication fee and a drainage plan
approved by the City Engineer. Mr. Singer stated
he was not aware of the requirement for �drainage '
plans until now.

Corianissioner Fratun referred to the letters written
by the two neighbors and expressed his concern
about their ob'jections to the subdivision„
Comnissioner Hurr felt that since Mr. plowman had
put out a great desl of money in buying this
property and a great deal of time planning to
divide the property, that a hardship was demonstrated.
She also co�ented that this subdivision did qualify
under the old requirements.- Mayor Van Nest �
explained that a hardship is a natural problem
with the land or topography of the property which
causes a hardship, not necessarily a ffnancial
problem.

Comnissioner Hassel stated the approval of this
subdivision is a matter of principle and inter-
pretation of the ordinance versus the policy. '
He continued that to divide this property causes
riparian lot rights, which is a poliCy problem.
There being no further discussion, Comanissioner
Hassel moved, Cortm�issioner Wilson seconded, a
motion to reconunend denial of the request by
Joe Braun for preliminary approval of the proposed
subdivision because the lots do not meet the 100 ft.
minimum lakeshore lot width requirement. T't�e
Cormnission also reconanended that the Council
should keep in mind that this subdivision has
been in process for a very long time.

by Mayor Van Nest, Mr. Schneider stated the south
property has access onto Stubbs Bay Road, adding

tion of the westerly parcel with the south property
has not been mentioned before.
