a Minnesota municipal corporation ("City") Neil & Barbara Goodwin ('Owners").
Recitais
1. A building permit app(ication has been filed for a new principal structure located at
2975 Cacso Point Road the("Subject Property"), legally described on attached Exhibit A..
2. Owners request the City to review this appli�ation.
3. The City wil( commence its review of the application and incur costs associated with said review '
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. �
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. AI1 accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account. �
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all aut-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review} or will incur in reviewing the plan. Eligible expenses shalf be consistent with expenses the
Owners would be responsible for under a building perrnit application. The escrow will also guarantee

1. An application far a demolition permit has been filed for princi�al structure located at ,

Exhibit"B".
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreemerrt,
the Owners shall deposit$2,500 with the City. AIE accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administeNng the escrow account.
2. PURFOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for
all out-of-pocket costs(including planning, enginesring, or tegal consultan#review)the City has incurred to assure that
the erosion control measures are installed and maintained so the property complies with the provisions of Orono City
Code Chapter 79. The financial security may also be used by the City to eliminate any h�zardous conditions
associated with the work and to repair any damage to public property or infrastructure that is caused by the work. if
compliance with the approved Land Disturbance Permit is not accomplished within the allowable time period, the City
may bring the project into compliance by use of the security.
3. RIt3HT OF ENTRY. The Owners hereby grant the City, its agents, employees, officers and
contractars the right to enter the prope�tq to perform ail work and inspections deemed appropriete by the City in
conjunction with the required erosion control measures, including but not limited to constructing or completing any and
all of the agreed upon improvements should the Owners' contractor not complete those improvements by the date
specified herein.
3. MONTHLY BILLING. As the City receives consultant bllls for incurred costs, the City wlll in tum

of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make
payment to the City within the timeframe outlined in#3 above, the City may draw from the escrow account without
further approval of the Owner to reimburse the City for eligible expenses the City has incurred. The Ciry shall
notify the Owner of such draw and the nature of the expense for which the reimbursement is being made. If the
Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional sums as
directed by the City, or the City shall discontinue all review.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owner when the review has been completed.

The plan we had for our 11-4-13 survey was 10-10-13 but the latest one they sent me said 11-20-13 Construction set,
Revised 12-31-13 but it wasn't a stamped city copy,just a copy emailed from their office.This later set appears match
what was built.The 10-10-13 set didn't have a lot of details so that is why I asked what heights to use.

Melanie: I was scratching my head on this too because the basement was right on but the foundation walls weren't
working out so I called Adam at the architect's office because he gave me the floor heights to use. I had him send me
over their latest plans which were dated 11-20 and 12-31-13 which is after our 11-4-13 latest survey. I checked over the
plans and the house is built to what the plans show but the plans were revised from the earlier heights Adam had me
use.There are also so many different ledges and heights to the foundation which make it confusing. I went out there
twice myself in bone chilling wind to try and figure it out and only when I got the revised plans did it make sense. Let me
know if you need anything else.

I have some questions about the foundation as-built dropped off this week for the Goodwin project at 2975 Casco Point
Road.... The proposed main floor elevation was to be 950.5' it looks to me (based on the foundation as-built) like the main
floor will be 952.5 or higher. Is this the case? Without doing too much more analysis on my end can you confirm that I'm
reading this correctly? It may not matter for the basement/number of stories calculation but I just would like to know what,
if anything changed.
I attached the scan of the foundation as-built to this email.

Our engineer and I have reviewed the as-built& hardcover calcs and our engineer visited the site this afternoon. I will
prepare the CO for issuance tomorrow morning; I will call you when it is ready.
In the meantime can you please send me photos of the lakeshore improvements? The survey does not indicate there are
rock outcroppings there... which I believe are OK from a hardcover standpoint, but I would like some documentation.
Also, there is a stone border which extends off of the property into the right of way. This has been reviewed and can
remain, however if damaged by snow plows, etc it is not the responsibility of the City.
Finally, although we didn't have a wall plan before construction, Lincoln did a good job of keeping the new walls near the
patios below 42"within the average lakeshore setback area so they can remain...
I'll call you tomorrow when the CO is ready.
