A RESOLIITION VACATING AN IINUSED Y�ORTION OF`
GRANDVIEW PI,AC$ WITHIN TH$ PLAT OF MOIINT HOME PARR
S$CTIOP 7, TOWNSHIP 117, RANGL 23 IN THE
CITY OF ORONO, MINNSSOTA
FILE NO. 1036
WH$R$AS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WH$RBAS, on May 23, 1986, Nancy Ferrell filed a petition
with the City of Orono requesting the vacativn of a portion of
Grandview Place originally dedicated in the plat of Mount Home Park
legally described as follows: •
That part of the adjoining West half of vacated Grandview Place
� • lying between the Easterly extensions across it of the North line
of Lot 1, Block 4, Mount Home Park and the South line of Lot 8,
Block 4, Mount Home Park, Hennepin County, Minnesota; and
WHBR$AS, after due published and posted notice, a public
hearing was held before the City Planning Commission on June 16, 1986,
regarding said vacation and all persons interested were given an
opportunity to be heard; and �
WH$REAS, after due standing and consideration, the Planning
Commission recommended approval of the requested vacation and the
Council of the City of Orono finds that said vacation, as proposed, is
� in keeping with the public interest in consideration of the following
findings:
l. The vacation does not affect access to or use of any
adjoining property. �
2. The City has not and does not intend to develop, improve
or use the dedicated right-of-way as a road except for
utilities and access purposes hereinafter described.
3. The unimproved dedicated right-of-way as it exists serves
no public purpose.
NOW, TH$REFOR$, B$ IT R$SOLVBD, that the petition of Nancy
• Ferrell is hereby granted and that the portion bf Grandview Place
legally described above is hereby vacated. The granting of the
petition is subject to the following condition:

1. Applicant shall grant to the City a utility and access
easement over the easterly 10 ' of the roadway to be vacated.
Adopted by the City Council of the City of Orono, �Minnesota
at a regular meeting held July 14, 1986. � .
