'��.a�,. _ _�_ .:. � , • " • • .... � ,� -� . � � . �; �! � A RESOLDTION APPROVING THE PLAT OF NORTH STRE�I � • APPLICATION NO. 918 WHEREAS; the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and k' f WHBREAS, the City Counci 1 of the City of Orono has adopted sub- division regulations for the orderly, economic and safe development of land within the City; and ' WH$R$AS, the City Council has considered the application for . subdivision by John D. Nordstrom, the subdivider; and ,: • WHERBAS, the subdivision has been found to meet all standards of the RR-1B zoning district finding that each lot is of a size and configura- ' tion that will allow its use as a single family residence to be fully ; developed without the need of any variances; and � F � WHE1t�AS, the subdivider has completed all requirements of the y� platting regulations of the City, including: . l. Dedication of Drainage .and Utility Easements on the plat. •' 2. Dedication on the plat of right of way for a public road shown as ; Spring Hi 11 Road. �� 3. Creation of a new private road shown on the plat as Outlot B to be >, known henceforth as North Stream Road. � 4. Concurrent with the creation of this private road, the Subdivider has dedicated to the City a Road and Utilities Easement granting to ~ the City permanent access, improvement and utility easements over said " �Outlot; the Subdivider has created non-exclusive ingress, egress, ;� drainage and utility easements over said Outlot in favor of all , abutting and/or benefiting lots including a declaration of• certain maintenance covenants wherein each of the abutting and/or benefiting ,' lot owners covenants and agrees to permanently maintain and pay the �• cost of maintenance for said private road. .�� 5. ' r � _ , . � • ' , � : .�! 6. Execution of a Developer's Agreement providing for installation of certain improvements as a condition of subdivision approval. The improvements required by the City are as follows: � a) North Stream Road to be constructed per standards for private = road serving 5 lots: ` -Gravel base to consist of 8" of Class 5, 1007 crushed rock *� -Paved 24" surface of 3" 2341 Bituminous surface b) Private driveway serving Lots 1,2 & 3 to be constructed per �, engineering plans by Mark S. Gronberg dated June 18, 1986. . � 7. Payment to the City of a Park Dedication Fee in the amount of ` • $800.00. � � 8. Payment to the the City for the lega1 review and filing of the plat, easements and covenants in the amount of .$150. 00. NOW, TH$R$FORB, B� IT R$SOL�I$D that based upon either one or more of the f indings noted above the City Counci 1 of the City of Orono hereby approves the formal plat of North Stream, Hennepin County, Minnesota and further grants a street frontage variance with the creation of a private • road designated as Outlot B subject to the following conditions: � ' 1. The City shall not issue building permits for Lots 1 and 2 until ' the driveway serving the existing residence has been removed and the area completely restored per City's approval. 2. The City shall not issue building permits for new construction on Lots 1,2,4 & 5 unti 1 the gravel base work for North Stream Road has � . been approved by the City. . - 3. Applicant is hereby advised that per the date of this subdivision approval, the City of Orono's current lakeshore setback of 75 feet is effective. The Department of Natural Resources has placed the City on notice that more restrictive setback standards must be adopted by the ' City at some future date. The setbacks are as follows: -All structures require 200 feet setback from Lydiard Lake - -All septic systems require 150 feet setback from Lydiard Lake � 4. The af oresaid p 1 at sha 11 be f i 1 ed by the City of Orono with the Hennepin County Recorder's Office on or before December 23, 1986 together with a certified original copy of this Resolution and ' executed copies of documents noted above. , Page 2 of 3 ' .� , o � r r �it� o� ORONO � RESOLUTION OF THE CITY COUNCIL Q� � NO. 2013 • - • • The approval granted by this Resolution shall expire if the plat has not been fi led by the date specif ied above. In that event, it wi 11 be necessary to file a new application with the City of Orono for subdivision review.
