A RLSOLIITION ALLOWING �
ENCROACHMENT OF A BOATHOUSE
ONTO A PDBLIC ALLEY
4075 HIGHWOOD ROAD
WHEREAS, Jan and Nora Ackerberg (hereinafter "the
applicant") are the owners of the property located at 4075 Highwood
Road within the City of Orono (hereinafter "City"); and
WHEREAS, existing on the applicant's property is a boat
house that is partially on a public alley adajcent to 4075 Highwood ,
Road; and .
WH$REAS, the boathouse is a non-conforming structure as per
• Section 10.03, Subdivision 4 of the Orono Municipal Code; and
WHER$AS, the Orono City staff has determined that the
. encroachment of the� boat house onto the al ley does not deter public
access at this time. ,
NOW, THSREFORE, BE IT RESOLVED that the Orono City Council
does hereby authorize the existance of the boat house on the public
alley until such time that any of the conditions in Section 10.03,
Subdivision 4 of the Orono Municipal Code occur or the Council
determines that it is a detriment to its access or right of way.
� FDTHER, Ll3T IT BE RESOLVSD that this permit does not create
any property right of the building owner as it relates to the right of
� way or the City of Orono's right, thereto.
Adopted by the Orono City Council on this 9th day of June,
1986.
