Dear Mr. Rozeboan:
RE: tJNAUTHORIZID FILL, V90-6211, LAI M7NNE'IONKA (27-133) SPRING PARK BAY
#11, CITY OF ORONO, HENNEPIN QOUN'I'Y
A follow-up inspection of your property on October 10, 1990 revealed that the
unauthorized beach sand has been satisfactcrily altered to dimensions that do
not require a DNR pennit. Because you hav chosen voluntary restoration, you
are not responsible for any violation or field inspection costs, and violation
file V90-6211 has been closed.
It is itortant to remember in the future that any project constructed below
the ordinary high water level (OHW) tha: alters the course, current, or
cross-section of a protected water or wetlazd is under the jurisdiction of the
DNR and may requise a permi.t. Work done without a valid DNR pezmit is
ccnsidered a misdneanor according to Minnesota. Statutes 103G. For your
information, I have enclosed a brochure that stutmarizes the work that can be
done without a DNR protected waters permit.
You are further advised that the City of Orono, Minnehaha Creek Watershed
District, and the U.S. Army Corps of Fgineers should also be consulted
regarding any future shoreline projects. The Minnehaha Creek Watershed
District (Fton Quanbeck @ 473-4224) requirs permits for all sand blankets
placed on Lake Minnetonka, and should be contacted, if you have not already
done so, to obtain the necessary permit for the rnaining sand.
Your cooperation in resolving this matter is appreciated. Please contact Area
Hydrologist Ceil Strauss at 772-7910 should you have any q_uestions.
Sincerely,
