INCOMPLETE
The City received a building permit application for a deck that was constructed at the
above address, which is located within the LR-1 C zoning district. The permit cannot be
issued at this time.
Permit applications for structures, whether new or replacement, require submittal of an
updated Certificate of Survey meeting the City's standards. Those survey standards are
attached. The photo copies of a survey, date unknown does not contain all of the
information required to complete our review. The property is within the Shoreland and is
subject to hardcover regulations. The hardcover calculations must be calculated by a
Licensed Surveyor.
In summary, a revised survey and hardcover calculation worksheets are required. Please

RE: Deck Construction at 2965 Casco Point Road
This letter is regarding the deck which was constructed at 2965 Casco Point Road
without a building permit. City Code 78-1279 regulates the placement of structures on
properties within the City. On lakeshore properties no structure is allowed within 75' of
the lake. New structures are not permitted within 75' of the lake. Further, City Code 78-
1288 prohibits hardcover within 75' of the lake; however a lake access stair is permitted.
The City does not have a permit record for the original deck. Replacing the deck in-kind
is allowed with a building permit.
A survey dated, June 18, 2008 shows the deck 14' x 9' located approximately 8 feet from
the southern, side property line. In a more recent survey dated November 12, 2009 the
deck is now shown to be 22' x 12' spanning from property line to property line. The deck
also appears to cross over the northern property line.
This letter is your official notification that the deck is in violation of City Codes. The City
requires that the deck be removed in order bring the property into compliance. If the
deck is not removed or a complete after-the-fact variance application request submitted
by January 20, 2010 this matter will be forwarded to our Attorney for legal action. A
variance application is enclosed and a meeting with City staff is required prior to
submittal. Please remove the deck or complete the application and schedule a meeting
with me prior to January 9, 2010 to avoid legal action by the City.

Sec. 78-1279.Placement of structures on lots.
When more than one setback applies to a site, structures and facilities must be located to meet all
setbacks. Structures shall be located as follows:
(1) Structure and on-site sewerage system setbacks (in feet)from ordinary high wate��level:

(3) Bluff inapactzones. Structures and accessory facilities, except stairways, landings and
lock boxes, must not be placed within bluff impact zones.
(4) Uses without water-oriented needs. Uses without water-oriented needs must be located
on lots or parcels without public waters frontage, or, if located on lots or parcels with
public waters fronta�e,must either be set back double the normal ardinary high water
level setback or be substantially screened from view from the water by vegetation or
topography,assuming summer, leaf-on conditions.
(5) Fences, docks, retaining walls. No fence shall be placed within the shore setback zone.
Portions of dock located landward of the OHWL shall be considered as a landing, subject
to the regulations for landings per section 78-1282. Retaining walls shall not be placed
within the shore setback zone.
(6) Average lakesho�•e setback. No principal or accessory structure shall be located closer to
the lakeshore than the average distance from the shoreline of existing residence buildinas
on adjacent lots; except that this does not apply to stairways, lifts, landin�s and lockboxes.
Further,the average lakeshore setback shall apply only to classified lakes and shall not
apply to tributaries. The average lakeshore setback line shall be a straight]ine connectin�
the most lakeward protrusions of the residence buildings on the immediately adjacent
lakeshore lots.
a. In instances where the average lakeshore setback can not be met,administrative
approval may be�ranted at the discretion of the planning director provided no
lake views of an adjacent lakeshore lot are obstructed and adjacent neighbors

Sec.78-1288. Hard cover limitations.
(a) Hardcover allotment. The following hardcover restrictions apply to all properties in the
Shoreland Overlay District:
(1) Hardcover�ones.
a. Within 75 feet ofthe Ordinary High Water Level(OHWL)ofany lake or
tributary,no hard cover or impervious surface shall be placed, located or
constructed,except for driveways, stairways,lifts, landings and]ockboxes as
regulated elsewhere in this Code.
b. Between 75 feet and 250 feet of the OH WL,there shall be no greater than 25
percenthardcover.
c. Between 250 feet and 500 feet of the OHWL there shall be no greater than 30
percenthardcover.
d. Between 500 feet and I,000 feet of the OHWL there shall be no greater than 35
percent hardcover.

I researched the historical information and the City's aerial photos and it appears that the previous deck was not a
LEGAL nonconformity, therefore it cannot be rebuilt in kind. If the property owner wishes to have a deck they must
receive a variance—as we discussed. It is still my recommendation that the owner propose to reduce the deck's size to
no larger than what was there before and center it on the property for more of a setback from the property lines.
