Sec.13.0�1 RIGHTS OFSUBJECTS OFDATA
Subdivisron 1. Type ojdata The rights of rndividual on whom the data is stored or to be stored shall be as set jorth rn this section.
Subd.2. Information required lo be given individuaL An indrvrdua!asked to supply private or confidential data concerning hrmselj
shall be informed of (a)the purpose and rntended use ojthe requested data withrn the collecting stale agency,polrtica!subdrvision,or statewide
system;(bJ whether he may refuse or is lega!!y required!o supply the requested data;(cJ arry known cansequence arisrng from his supplying or
refusrng to supply private or confidentral data;and(d)the identity of olher persons or entitres authorized by state orfederal law to receive the data.
This requirement shall not apply when an indivrdual is asked to supply investigative data,pursuant to section /3.82, subdrvrsron 5, to a!mv
enjorcement o�cer.
The commissianer of reven:re may D1ace the notice required under this subdivision in the individual income tax or Droperry tax refund
instructions instead of on those forms.
Subd.3. Access to data by individuaG Upon request lo a responsible authoriry,an individual shall be injarmed whether he rs lhe subject
of stored data on indivrduals, and whether it is classrfied as public,private or confrdential. Upon his further request,an rndivrdual who is the
subjecr ojstored private ar public data on individuals shall be shoivn the data without arry charge to hrm and, rf he desrres,shal!be rnformed of
�he content and meanrng of that data. After an indivrdual has been shotivn the prrvate data and injormed of its meaning, the data need nol be
disclosed to him for srx months lhereajter unless a dispute or action pursuant to Ihis sectton is pendrng or additiona!data on the indrvidua!has
been collected or created. The responsible authority shall provrde copies of the private or public data upon request by the indivrdual subject oj
the da1a. The responsible authority may require the requesting person to pay the actual costs of making,certifying,and compiling the copres.
The responsible authoriry shall comply immediately,ifpossible,with any request made pursuant to this subdivision,or x�ithin frve days
af the date ojthe request,excludrng Saturdays,Sundays and legal holydays,iJrmmediate compliance rs not possible. If he cannot comply with the
request within that time,he shall so inform the individual,and may have an additional five days within which to comply with the request,excluding
Saturdays,Sundays and lega!holydays.
Subd.4. Procedure when data is not accurate or complet�An individua!may contesl the accuracy or completeness oJpublic or private
data concerning himself. To exercise this right, an individual shall notify in writing 1he responsible authority describing the nature oj the
disagreement. The responsible aulhorrty shall within 30 days erther: (a)correct the datajound to be inaccurate or incomplete and attempt to notify
past recrpients of inaccurate or incomplele data,includrng recrpients named by the rndividual;or(b)not�the rndrvrdual that he believes the data
to be correct. Data rn dispute shal!be disc[osed only if the rndivrdua!'s statement of disagreement is included with the drsclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions ojthe administrative procedure ac1 relating
to contes�ed cases.
