City staff received a complaint regarding the addition to the play structure at 2948 Casco Point
Road. As a result of the complaint, City Staff performed a property inspection on May 30, 3012.
During the inspection Staff noted an addition to a play structure which appears to be located
within 75' of the Ordinary High Water Level (OHWL) and further encroaches within the average
� . lakeshore setback. The addition violates City Code Sections 78-1288(a)(1)(a) and 78-1279(6).
This letter will serve as your notice that the property must be brought into compliance
before Monday, June 18, 2012. In order to bring your property into compliance the addition
must be removed from the property before Monday, June 18, 2012.

Sec. 78-1279. Placement of structures on lots.
When more than one setback applies to a site, structures and facilities must be located to meet
all setbacks. Structures shall be located as follows:
(1) Structure and on-site sewerage system setbacks (in feet) from ordinary high water level:

(2) Additional structure setbacks. The following additional structure setbacks apply,
regardless of the classification of the water body:

* Except for detached garages on lakeshore lots as regulated in section 78-1435 and
except for structures subject to less restrictive side yard adjacent to street setbacks as
regulated in the various zoning districts.
(3) Bluff impact zones. Structures and accessory facilities, except stairways, landings and
lock boxes, must not be placed within bluff impact zones.
(4) Uses without water-oriented needs. Uses without water-oriented needs must be located
on lots or parcels without public waters frontage, or, if located on lots or parcels with
public waters frontage, must either be set back double the normal ordinary high water
level setback or be substantially screened from view from the water by vegetation or
topography, assuming summer, leaf-on conditions.
(5) Fences, docks, retaining walls. No fence shall be placed within the shore setback zone.
Portions of dock located landward of the OHWL shall be considered as a landing, subject
to the regulations for landings per section 78-1282. Retaining walis shall not be placed
within the shore setback zone.
(6) Average lakeshore setback. No principal or accessory structure shall be located closer to
the lakeshore than the average distance from the shoreline of existing residence
buildings on adjacent lots; except that this does not apply to stairways, lifts, landings and
lockboxes. Further, the average lakeshore setback shall apply only to classified lakes and
shall not apply to tributaries. The average lakeshore setback line shall be a straight line
connecting the most lakeward protrusions of the residence buildings on the immediately
adjacent lakeshore lots.
a. In instances where the average lakeshore setback can not be met, administrative
approval may be granted at the discretion of the planning director provided no
lake views of an adjacent lakeshore lot are obstructed and adjacent neighbors
provide written approval.

Sec. 78-1288. Hard cover limitations.
(a) Hardcover allotment. The following hardcover restrictions apply to all properties in the
Shoreland Overlay District:
(1) Hardcover zones.
a. Within 75 feet of the Ordinary High Water Level (OHWL) of any lake or
tributary, no hard cover or impervious surface shall be placed, located or
constructed, except for driveways, stairways, lifts, landings and
lockboxes as regulated elsewhere in this Code.
b. Between 75 feet and 250 feet of the OHWL, there shall be no greater
than 25 percent hardcover.
c. Between 250 feet and 500 feet of the OHWL there shall be no greater
than 30 percent hardcover.
d. Between 500 feet and 1,000 feet of the OHWL there shall be no greater
than 35 percent hardcover.

I spoke with Mr.Johncox this morning and he proposed to remove the guard rail but leave the walkway. Due to the fact

City staff received a complaint regarding the addition to the play structure located at 2948 Casco
Point Road. The play structure currently is located forward of the average lakeshore setback, but
the newly constructed walkway and guard rails on top of the play structure further encroach into the
average lakeshore setback which violate City Code Section 78-1279(6).
This letter will serve as your notice that the property must be brought into compliance before
Thursday, September 13, 2012. In order to bring your property into compliance the walk way and
guard rails must be completely removed before Thursday, September 13, 2012.

Sec. 78-1279. Placement of structures on lots.
When more than one setback applies to a site, structures and facilities must be located to meet all
setbacks. Structures shall be located as follows:
(1) Structure and on-site sewerage system setbacks (in feet) from ordinary high water level:

* Except for detached garages on lakeshore lots as regulated in section 78-1435 and except for
structures subject to less restrictive side yard adjacent to street setbacks as regulated in the
various zoning districts.
(3) Bluff impact zones. Structures and accessory facilities, except stairways, landings and lock
boxes, must not be placed within bluff impact zones.
(4) Uses without water-oriented needs. Uses without water-oriented needs must be located on lots or
parcels without public waters frontage, or, if located on lots or parceis with pubiic waters frontage,
must either be set back double the normal ordinary high water level setback or be substantially
screened from view from the water by vegetation or topography, assuming summer, leaf-on
conditions.
(5) Fences, docks, retaining walls. No fence shall be placed within the shore setback zone. Portions
of dock located landward of the OHWL shall be considered as a landing, subject to the
regulations for landings per section 78-1282. Retaining walls shall not be placed within the shore
setback zone.
(6) Average lakeshore setback. No principal or accessory structure shall be located closer to the
lakeshore than the average distance from the shoreline of existing residence buildings on
adjacent lots; except that this does not apply to stairways, lifts, landings and lockboxes. Further,
the average lakeshore setback shall apply only to classified lakes and shall not apply to
tributaries. The average lakeshore setback line shall be a straight line connecting the most
lakeward protrusions of the residence buildings on the immediately adjacent lakeshore lots.
a. In instances where the average lakeshore setback can not be met, administrative
approval may be granted at the discretion of the planning director provided no lake views
of an adjacent lakeshore lot are obstructed and adjacent neighbors provide written
approval.

Because permits were issued in 2002 using a (city) staff calculated hardcover it is important for me to know that the
property is in conformance with our hardcover limitations prior to issuing a new permit. We require hardcover
conformance even if oniy going from non-structurai hardcover to structural hardcover. I have attached the 2002 survey
and staff calcs.
If you can certify an as-built hardcover survey/hardcover calculation sheet and the property is not out of compliance that
would be all we would need. If it does not conform I believe the project is a no-go.
