Recitals
1. Owner has filed an Application for a building permit formally requesting the City to review pians
for a (circle one) new principal structure located at 2933 Casco Point Road (the "Subject Property"), as more .
fully shown and described on Exhibit"A" attached hereto.
2. Owner requests the City to review said plans which requires City approval including Buildinq
Permit, Erosion & Runoff Control Plan and Gradinq Plan Review. /a-erjytt c�'-�' ��-��%�2.�
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owner shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owner would be responsible for under a zoning and subdivision application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days of the Owner's receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make
payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without
further approval of the Owner to reimburse the City for Eligible expenses the City has incurred. The City shall
notify the Owner the Owner of such draw and the nature of the expense for which the reimbursement is being
made. If the Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional
sums as directed by the City, or the City shall discontinue review and post a Stop Work Order.
4. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owner when the review has been completed and written notification is received from the Owner requesting the
funds.
5. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

the right to enter the property to perform all work and inspections deemed appropriate by the City in conjunction with the
required erosion control measures, including but not limited to constructing or completing any and all of the agreed upon
improvements should the Owner's contractor not complete those improvements by the date specified herein.

I have begun the zoning review of the building permit application for 2933 Casco Point Road. I have not yet received
comments from the City's engineer regarding the grading plan however l do have a few comments.
1. I have attached an escrow agreement form to be completed and signed by the property owner, not the
applicant. Additionally,the property owner will be required to submit a check for the $2500.00 escrow. I
understand that there was a misunderstanding at the time the permit application was dropped off and the
check you submitted was used to cover the plan review fee, as we require plan review fees to be paid up front.
2. Please submit hardcover calculations for the 0-75' zone. It appears you are not changing anything in that zone
but accurate hardcover calculations are required.
3. It appears that the existing curb cut at the road is to be re-used. The City has a maximum allowed curb cut of
20'. Please reduce the curb cut to comply with the 20' maximum.
4. The survey as submitted was not signed by the surveyor. Following any comments or needed revisions by the
City's engineer the final copy of the surveys submitted must be signed originals by the surveyor.
5. The building permit approval process requires that you submit a copy of your erosion control permit issued by
the MCWD. Please do so. Additionally, please see the attached information about Construction Site Runoff.
Again,the City engineer has not yet submitted his comments to me on this plan. Further revisions or information may
be needed. Following approval of the grading plan by the City's engineer the permit application &plans will be
forwarded to the Building Official to complete the plan review.

Lyle Oman (our Building Official) has been ill the past two days. He is the one who needs to complete the building plan
review and ultimately sign off on issuance of the permit. If he is back tomorrow I will remind him first thing in the AM.
i do have the escrow agreement(attached) for the erosion control portion of your permit for the owner to sign and
submit a check for$2000.00 at the time when you pay for and pick up the permit.

Your project is subject to Orono regulations regarding Construction Site Runoff Control. The
purpose of these regulations is to protect wetlands and lakes. You are responsible for
complying with these regulations. The following is an abbreviated summary of the
regulations.
1. If your project requires a permit from the Minnehaha Creek Watershed District
(MCWD) or Minnesota Pollution Control Agency (MPCA), you must also apply for and
comply with those permit requirements.
2. Soil that accumulates behind a silt fence must be removed when it reaches a third of
the way to the top of the fence.
3. All disturbed ground left inactive more than 14 days must be either temporarily or
permanently stabilized (mulch, seed and mulch, sod, hydromulch, etc.)
4. You must provide sanitary facilities for all on-site workers, either a portable toilet or
access to the permanent facilities.
5. Refuse and materials to be recycled must either be taken off site at the end of each
work day or be placed in a dumpster. The dumpster must be emptied as necessary.
6. Vehicles must enter and leave the site by means of the existing driveway or the
stabilized construction entrance.
7. Construction parking must be located on site, on a paved roadway, or an improved
shoulder.
8. Any material tracked onto a roadway must be removed by the end of the work day.

• We understand that additional work may be proposed on the retaining walls and

Please review the attached grading plan for a new house to replace the existing one.
This is the property we visited to evaluate the lakeshore for retaining walls. The
contractor made it very clear they are doing no work in that area.

I have begun the zoning review of the building permit application for 2933 Casco Point Road. I have not yet received
comments from the City's engineer regarding the grading plan however l do have a few comments.
1. I have attached an escrow agreement form to be completed and signed by the property owner, not the
applicant. Additionally,the property owner will be required to submit a check for the $2500.00 escrow. I
understand that there was a misunderstanding at the time the permit application was dropped off and the
check you submitted was used to cover the plan review fee, as we require plan review fees to be paid up front.
2. Please submit hardcover calculations for the 0-75' zone. It appears you are not changing anything in that zone
but accurate hardcover calculations are required.
3. It appears that the existing curb cut at the road is to be re-used. The City has a maximum allowed curb cut of
20'. Please reduce the curb cut to comply with the 20' maximum.
4. The survey as submitted was not signed by the surveyor. Following any comments or needed revisions by the
City's engineer the final copy of the surveys submitted must be signed originals by the surveyor.
5. The building permit approval process requires that you submit a copy of your erosion control permit issued by
the MCWD. Please do so. Additionally, please see the attached information about Construction Site Runoff.
Again, the City engineer has not yet submitted his comments to me on this plan. Further revisions or information may
be needed. Following approval of the grading plan by the City's engineer the permit application & plans will be
forwarded to the Building Official to complete the plan review.

3. It appears that the existing curb cut at the road is to be re-used. The City has a maximum
allowed curb cut of 20'. Please reduce the curb cut to comply with the 20' maximum.
4. The survey as submitted was not signed by the surveyor. Following any comments or needed
revisions by the City's engineer the final copy of the surveys submitted must be signed originals
by the surveyor.
5. The building permit approval process requires that you submit a copy of your erosion control
permit issued by the MCWD. Please do so. Additionally, please see the attached information
about Construction Site Runoff.
Again, the City engineer has not yet submitted his comments to me on this plan. Further revisions or
information may be needed. Following approval of the grading plan by the City's engineer the permit
application & plans will be forwarded to the Building Official to complete the plan review.

removed 30 days thereafter.
Maintenance: Inspect silt fence at least once a week and after each rainfalL Make any

ineffective, replace within 24 hours of discovery.
General Notes
1. All compacted soil shall be broken up to a depth of at least 6" prior to
landscaping.

Chad Johnson recently visited your job site at 2933 Casco Point Road to follow up his letter of
November 13 concerning winter erosion control. He indicates that your silt fence is not fully

Tom reviewed your letter and indicated it was appropriate to send out to the smaller
projects that you haven't been monitoring. I left your name on it because I didn't think
there was anyone here who could answer technical questions about it. Because of the
delay in sending it out I added a few days to the compliance deadline. 'These are going out
in today's mail so you can expect phone calls on Monday.
All but two of these are single-family houses under construction on isolated lots. Some
have just commenced, some have been under construction for a while. Crystal Place is a
detached garage on a tiny lot that disturbed most of the lot. (Jasin even removed part of
his house to provide access to the garage.) Cherry Avenue is a major addition between the
lake and a wetland. Tom and Darren reviewed the grading plans for all these permits.
There may be more letters going out next week as I dig more information out of the permit
system.

The active summer construction season is fast drawing to a close here in the state of winter and frozen
ground. As we move into a new season it is important we take the proper precautions on our active sites
to help eliminate any erosion problems or added expenses that may be incurred due to winter freeze thaw
events and the inevitable spring runoff. As construction continues throughout the winter in the City of
Orono it is important to minimize the amount of open soil by providing temporary or permanent cover,
one of the key elements in preventing soil loss. It is also required that the appropriate BMPs be
maintained on-site by December l, 2009 as follows:
■ Exposed soil areas must be stabilized with the appropriate seed mix and erosion control
blanket, disc anchored mulch applied at a rate of 2 tons per acre or other effective means to
control erosion.
o Areas requiring stabilization will include but are not limited to small miscellaneous
areas, landscaping areas, sidewalk backfill,non-active stockpiles, finished grading
areas, etc.
o Areas being worked after November 26th must be stabilized weekly until
construction ends.
o In the event that it snows and there are frozen ground conditions, mulch can be
applied effectively over the snow.
■ Seeding must be completed with the appropriate seed mix as indicated below. Dormant
seeding shall be done in the later fall after the soil temperature is consistently below 50
degrees Fahrenheit. Seeding done before or after the indicated seed dates may require
reseeding if the seed does not take. In the event that it snows and there are frozen ground
conditions, seed can be applied effectively over the snow.

■ Rock construction entrances to access the construction site and prevent tracking sediment
off site
■ Silt fence or an approved perimeter control device shall be installed to control runoff
■ Soil stockpiles should be eliminated or consolidated to the extent as possible and be
protected with perimeter control and mulch applied on all stockpiles that will remain dormant
for the winter months.
■ Storm Sewer inlet protection including curb and gutter catch basins,parking lot/road drains,
and backyard drop inlets must be:
o Maintained in a manner where all removal of sediment and debris, repairs as -
necessary, and or replacement are completed by November 26`�', 2009. Sediment shall
be removed when occupying greater than 1/3 the volume of the device,placed in an
upland area and stabilized.
o All"in-structure"and"on-structure devices shall be removed from the storm sewer
inlets by November 26t'', 2009 and re-installed in the storm sewer inlets by April 1,
2010.
BMP installation, such as silt fence, has a tendency to be more costly to install during the winter months
therefore it is recommended that all installation occur prior to the ground freezing on sites where work is
proposed to be done during the winter months. Regular construction site inspection will occur throughout
the winter months, and compliance with the Minnesota Pollution Control Agency(MPCA) construction
site general permit and the City Land Disturbance Permit will be expected.
