I- follaw-up inspection of your property on August 24, 1990 revealed that the
unauthorized beach sand has beer. satisfactorily altered to dimensions that do
not require a DNR pezmit. Because you have chosen voluntary restoration, you
are not responsible for an violation or field inspection costs, and violation
file V90-6209 has been closed.
It is inYportant to rnber in the future t:hat any project constructed below
the ordinary high water level (OHW) that alters the course, current, or
cross-section of a protected water or wetland is under the jurisdiction of the
DNR and may requ_ire a pezm.it. Work done without a valid DNR permit is
considered a misdeneanor accordir.g to NLinnesota Statutes 103G. For your
information, I have enclosed a brochure that sunarrizes the work that can be
done without a DNR protected waters permit.
You are fur'cher advised that the City or Orono, r'Ii.nnehaha Creek Watershed
District, and the U.S. Arnn Corps of Engineers should also be consulted
regarding any future shoreline prcjects you may anticipate.
Your cooperation in resolving this matter is appreciated. Please contact Area
Hydrologist Ceil Strauss ut 296-7523 should you have any questions.
Sincerely,
