' . . . . � � Clt o� ORONO � � RESOLUTION OF THE CITY COUNCIL � � NO. 1995 • � • • A RESOLIITION ORDERING ABATEMENT OF HAZAI2DOOS BIIILDING ACTION AT 1305 $lmwood Road, Orono WH$REAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and. � WH$RBAS, Muriel Hammer, 1305 Elmwoocl Road, Orono, Minnesota, 55364; is the fee owner of record of property located at 1305 `Elmwood Road, Orono, Minnesota, herein referred to as the Property, and legally described as follows: Lot 1, Block 7 Saga Hill Revised, Hennepin County; and y WHEREAS, the City Council of� the City of Orono, having ' • duly considered the matter pursuant to Minnesota Statutes Sections 463.15 to 463.261, hereby finds that the above described property is uninhabitable and contains unsanitary and hazardous conditions which constitute a public nuisance and which makes this property hazardous to the public health, safety and welfare based on the following findings: 1. Building has all interior sheet rock and finish material removed without required permits. 2. Roofing has been installed without permits and never completed. 3. Cistern in front yard full of water and accessible to children playing in the area. 4. Junk and debris scattered around the lot'. � . 5. Garage is being used for commercial storage without required license or inspections; window busted out. 6 . Building is in a state of deterioration and . dilapidation, thus it is a safety and health hazard pursuant to Minnesota State Building Code/Uniform Building Code, Section 203. i � 7. Orders to remove or repair the structure were issuecl by the Building Official on May 5, 1986. These orders have not been complied with. Page 1 of 2 � . That the City Counci 1 of the City of Orono, pursuant to the foregoing findings and in accordance with Minnesota Statutes Sections 463.15 to 463.261 hereby orders the owner(s) of the property to raze and remove the structure on the property. The Council further orders that all personal property or fixtures that may unreasonably interface with the razing be removed within twenty (20) days of the service of this order or the City of Orono may remove and sel 1 such personal property or fixtures at a pub,lic auction in accordance with the law. x 2. , The City Council of the City of Orono further orders that unless this corrective action is taken or an answer is served• upon the City of Orono and filed in the office of the Clerk of District Court of Hennepin County, Minnesota, within twenty (20) , � 3 days from the date of the service of this order, a motion for summary enforcement of this order wil 1 be made �at District Court of Hennepin County. �h 3. That the City Council of the City of Orono further orders that if the City is compelled to take corrective action herein all necessary costs expended by the City will be assessed against the real estate concerned and col lected in accordance with Minnesota Statute, Section 463.22. 4. That the City Council of the City of Orono hereby authorizes and directs the Mayor, City' Clerk, City Attorney, and other officers and employees of the City to take such action, prepare, sign and sezve such papers as are necessary to comply with this " Order and to assess the cost thereof against the real e:�tate described above for collection along with taxes.
