Clt� o� ORONO� � � • ' RESOLUT'ION OF THE CITY COUNCI L _ _ ___._� _. . . . � � NO. 1989 • - • • � A RESOLIITION GRANTING � � PRELIMINARY APPROVAL FOR A PLAT AT 755-763 NORTH FERNDALE ROAD APPLICATION NO. 1015 WHEREAS, Ervin F. Kamm, Jr., on March�� 25, 1986, filed a formal subdivision application with the City for approval of a two-lot residential plat of property legally described as: 1) The East 198 feet of the North 660 feet of Government Lot 3, Section 36, Township 118, Range 23, as measured along the North and East lines thereof respectively, according to the Government . Lot Survey thereof; and �2) Tract E, Registered Land Survey No. 1031, Files of Registrar • . of Titles, County of Hennepin, (hereinafter "property"); and . WHEREAS, after due published and mailed notice in accordance with Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and Platting Codes, the Orono Planning Commission held a public hearing on April 21, 1986, at which time .all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and o WHEREAS, at their regular meeting held on May 12, 1986, the Orono City Council considered the subdivision application of Ervin F. Kamm, Jr. noting the following findings of fact: 1. The property is located within the RR-1B Single Family Rural Residential Zoning District requiring a minimum of 2 acres of contiguous dry buildable land within each newly created lot. , 2. The property contains a total of 6.22 acres of dry buildable land. 3. Proposed Lot 1 contains 2.003 acres of dry buildable land; ' proposed Lot 2 contains 2.005 acres of dry buildable land; proposed Lot 3 contains 2.216 acres of dry buildable land. 4. The City will require that 33' feet of right-of-way for North Ferndale Road be dedicated on the Plat. 7. All of Lots l, 2, and 3 have been demonstrated to have suitable sites for primary and alternate drainfields to serve the . • proposed house or existing houses. . 8. A single family residence can be constructed on Lot 2 without the need for further variances. � NOW, THEREFORE BE IT RESOI.VED, that based upon either one or � more� of the findings noted above, the City Council of the City of Orono hereby approves the preliminary plat and the appropriate frontage variances as noted above for Ervin F. Kamm, Jr. 755-763 North Ferndale Road per the preliminary plat drawings by Coffin and GronYierg, Inc. dated March 25, 1986, subject to the following conditions : l. Roadway to be dedicated on the plat shall consist of 33' for � the right-of-way for North Ferndale Road. � 2. Standard drainage and utility easements shall be granted along all property lines. 3. Payment of park f ee of $2 0 0.0 0 f or Lot 2. The fol lowing list of final submittals must l�e submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month: � . l. RECORD PLAT drawings in the form of two (2) mylar copies (three (3 ) mylars if property is torrens property) and one (1) additional copy reduced to 1"=200'. Drawing to include: . a) Lot lines platted per preliminary plat drawings by Coffin and Gronberg, Inc. dated March 25, 1986. • b) Dedication of "drainage and utility easements" 10' wide along all perimeter property lines and 5' each side of internal property lines. c) Dedication of a 33' corridor for right-of-way for North Ferndale Road. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. • b) The applicant must provide certified copies of all recorded easements currently affecting the property. 3. FEES TO BE PAID: Total Due .$275.00 a) Park dedication fees per current schedule, calculated as follows: 1 new lot at 2+ acres = $200.00. b) Legal and Administrative review fees per current , schedule: $75.00. `• Adopted by the City Council of the City of Orono, Minnesota at regular meeting held May 12, 1986.
