t � WHEREAS, John B. A. Idstrom II, on August 23, 1985, filed a
'° formal subdivision application with the City �for approval of a two-lot
S
residential plat of property legally described as: •
� Lots 13 and 14, Auditor's Subdivision Number 229, Hennepin
�� County, Minnesota (hereafter "property" ) ; and
„
WHEREAS, after due published and mailed notice in accorclance with
- Minnesota Statues 462.358 et. seq. and the City of Orono Zoning and
. Platting Codes, the Orono Planning Commission held a public hearing on
� September 16, 1985, at which time all persons desiring to be heard
' concerning this application were given the opportunity to speak thereon;

. WHEREAS, the Planning Commission further reviewed this
: application concurrently with Application No.968, requesting variances and
a Conditional Use Permit for excavation in wetlands, on February 18, 1986;
� and
' WH$REAS, at their regular meeting held on March 10, 1986, the
;) Orono City Council considered the subdivision application o�f John B. A.
! Idstrom II noting the following findings of fact: .
""� 1. The property is located within the RR-1B Single Family Rural
� Residential zoning district requiring a minimum of 2 acres of
,.
� . contiguous dry buildable land within each newly created lot.
' 2. The property has a � total of 13.5 acres of land, 3.1 acres of
• which is considered wetland.
�� 3. Lot 1 contains 7.5 acres of dry buildable land, of which 3.6
.� acres of dry buildable land are contiguous with the proposed building
� site; Lot 2 contains 2.2 acres of contiguous dry buildable land west
� of a proposed easement for a driyeway serving Lot 1. .

+ 4. Both Lots 1 and 2 meet the minimum width requirements of 200
` feet; however, the proposed lot configuration requires a street

`; frontage variance for Lot 2, which does not abut or front on a public

;� 5. Lots 1 and 2 will share a single driveway access onto Fox Street
�.' , rather than accessing from the existing private road immediately west
�:` of the property, and this will require that appropriate access
�' easements of 20' width be granted from each new lot to the other.

� 6. The City will require a Conservation and Flowage Easement over
, the designated wetlands on Lots 1 and 2.
� 7. The City will require that 18.7 feet of additional right-of-way
4 for Fox Street be dedicated on the Plat. •
� 8. Both Lots 1 and 2 have been demonstrated to have suitable sit�s
' for primary and alternate drainfields to serve the proposed houses.

: • 9. Although Lot 1 contains enough dry buildable land to meet the
area standard for an additional future lot near Fox Street, such a
subdivision creating a 3rd lot on this proposed property would require
a replat of Lot 1 and would require construction of a road to
' � Residential Priva,te Road Standards to serve all 3 Lots and the City
; would at that time require that al 1 3 Lots gain access from such road
or would need to access onto Fox Run, and variances to the frontage
� requirements would be needed for the rear Lot.
' 10. The access to the proposed building site on Lot 1 requires a
.' variance and Conditional Use Permit in order to construct a driveway
,.:; across the designated wetland, which variances and Conditional Use
Permit were conceptually approved by the City Council on March 10,
, 1986.
� 11. Single family residences can be constructed on both Lots 1 and 2
without the need for further variances. ; and
� WH$REAS, the City will grant the variances and Conditional Use
' Permit for a 32' corridor for crossing of the wetlands as part of the Final
; Subdivi.sion Resolution. '
; NOW THEREFORE BE IT RESOLVED, that based upon either one br more
� of the findings noted above, the City Council of the City of Orono hereby
• approves the preliminary plat for John B.A. Idstrom II at 2580 Fox Street

holders or others with property interest indicated therein shall
