A RESOLUTION GRANTING
A VARIANCE TO
MIINICIPAL ZONING CODE
SECTION 10.55, SIIBDIVISION 8
AND S$CTION 10.22, SIIBDIVISIONS 1 and 2
• FILE #1006
. WHEREAS, Dale & Chris Palm (hereinafter "the applicants") are the
owners of the property located at 1710 Shadywood Road within the City of
Orono (hereinafter "City") and legally described as fol lows:
That part of Lot 11 lying Southerly of the following described line:
Beginning at the Southwest corner of the North 14 feet of said Lot;
thence South 87 degrees 27 minutes East to the shore of Crystal Bay
Lake Minnetonka; and that part of Lot 12, lying Northerly of a line .
drawn parallel with and distant 71.2 feet Northerly, measured at right
angles from the Southerly line of Lot 13, all in Shadywood, an
• addition to the County of Hennepin in the Township of Orono.
WHEREAS, the applicants have applied to the City for a variance
to Municipal Zoning Code Section 10.55, Subdivision 8 and Section 10.22,
Subdivisions 1 and 2 to permit the construction of an addition and attached
garage which will constitute additional structure and excessive hardcover
. in the 0-75 lakeshore setback zone where structures and hardcover are not
normally allowed, and which will increase hardcover in the 75-250'
. lakeshore setback zone to more than the 25� normally allowed.
NOW, THER}3FOR$, BE IT R$SOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1006.
2. The property is located in the LR-1C Single Family Lakeshore
Residential Zoning District.
3. The Orono Planning Commission reviewed this application on
February 18, 1986, and recommended approval of the proposed variances
based upon the following findings: �
A) The property is 16,840 square feet in area or 0.39
• acres, has an average width of approximately 90 feet, and
contains an existing house which extends approximately 20
feet into the 75' lakeshore setback zone, and contains on
existing detached garage and concrete apron which encroach
into the minimum required side and street setbacks.

B) The applicant proposes to remove certain items of existing
hardcover in the 0-75' lakeshore setback area so that the net
increase in 0-75' hardcover is 50 square feet or 0.7$.
' C) The attached garage and necessary driveway and backup apron
can be constructed such that hardcover will not exceed 30$ in
the 75-250' setback zone. '
D) The existing non-conforming garage will be removed and the
� proposed attached garage will meet the required street and side
lot line setbacks.
4. The applicant has proposed a driveway configuration that will
allow a net decrease of 0.5$ hardcover in the 75-250' zone, but does
not allow for a backup apron. The Council finds that for safety
purposes, a backup apron should be provided to avoid forcing vehicles
• to back onto County Road 19.
5. The Council finds no harclship to justify granting of a hardcover
• increase in the 0-75' setback zone.
6. The City Council has considered �this application including the
� findings and recommendations of the Planning Commission, reports by
City staff, comments by the applicant and the effect of the proposed
variance on the health, safety and welfare of the community.
7. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this zoning district; that granting the variance would not
adversely affect traffic conditions, light, air nor pose a fire hazard
or other danger to neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a
substantial property right of the applicant; and would be in keeping
with the spirit and intent of the Zoning Code and Comprehensive Plan
� of the City.
CONCLIISIONS, ORDER AND CONDITIONS -
Based upon the above findings, the Orono City Council hereby
grants a variance to the Municipal Zoning Code Sections � 10.55, Subdivision
• 8 and 10.22, Subdivisions 1 and 2 to permit the construction of an addition
and attached garage which may constitute additional structure in the 0-75'
lakeshore setback zone where structure is normally not allowed, but wil 1
not increase 0-75' hardcover above the existing 17.5$, and which will
increase the hardcover in the 75-250' setback zone from the existing 27.3�
to no greater than 29.0$, subject to the following conditions:

1. Prior to issuance of a building permit, the applicant shall submit
for City staff review and approval a final site plan proposing house
plan modifications and concurrent hardcover removals in the 0-75'
lakeshore setback zone, in order to confirm that there will be no net
increase in hardcover in the 0-75' lakeshore setback zone. Applicant
shall further remove the existing sidewalks, driveway apron, and
detached garage as shown on Exhibit A, prior to final inspection of
the additions.
2. Hardcover in the 0-75' lakeshore setback area shall not exc'eed
1150 square feet (17.5�). Hardcover in the 75-250' setback area shal 1
not exceed 2,980 square feet (29.0� ). Applicant is advised that.
• future proposed hardcover additions will likely be approved only with
concurrent removal of equivalent amounts of existing hardcover.
3. Authorities granted by this variance run with the property not
with the applicant, but are permissive only and must be exercised by
application for a building permit within one year of the date of
Council approval, or this variance will expire on that date (March 10,
1987 ) .

4. Violation of or non-compliance with any of the terms and
, conditions of this variance shal 1 constitute a violation of the zoning
code, shall automatically terminate any authority granted herein, and
shall be punishable as a misdemeanor.
5. The undersigned applicant has read, understood and hereby agrees
to the terms of this resolution and on behalf of himself, his heirs,
successors and assigns, hereby agrees to the recording of this
resolution .in the chain of title of the property.
