This letter is to inform you that a building permit is required for the placement or construction of a storage shed in the City of Orono, also storage sheds are required to meet setbacks and hardcover limits. The City requires a 75' setback from the lake and does not allow any hardcover within 75' of the lake. Therefore, the City must require you to file a permit application and move the shed to an approved location or remove it from your property by August 30, 1993. As of this date, the issue remains unresolved. Again your options are to remove the shed from the property or apply for a building permit to place the shed in accordance with the zoning code. A new deadline of November 10, 1993 has been established for removal or permit application submittal. The certificate of survey by Otto Associates which you provided contains a wealth of information which leads me to make the following comments: • The survey is extremely misleading, showing a dark line boundary that does not match the legal boundary of your property. No addendum was provided by you or your surveyor to explain the format of this survey. • The shed is clearly not within your property boundaries, but within the right-of- way of Carman Avenue. • The survey suggests a "proposed" change to your legal description which would place the shed approximately 4' within your property. However, you have not applied for a ��a�ation of a portion of Carman Avenue, and if you did so, the City would undoubtedly deny such a vacation given the DNR's consistent opposition to such proposals which reduce public access to lakes, and given the City's use of the right-of-way as a public beach area. • A site inspection reveals that the shed is approximately 8' from the normal shoreline (not 12'-14' as survey shows), and obviously within 75' of the lake where no structures or hardcover are allowed. Your surveyor did not identify the 929.4' elevation contour which is required by the City for all surveys abutting Lake Minnetonka. • The survey shows and site inspection verifies that your recent landscaping has encroached onto the 60' City right-of-way by as much as 20'. � Telephone (612) 473-7357 • FAX 473-0510 . Mr. Patrick Wolfe May 4, 1994 Page 2 • The fact that you had a boat house in the same location for many decades has little bearing on the Ciry's consideration of such structures. City codes are designed to eliminate such structures within rights-of-way or near the lakeshore as they deteriorate. Once the building was removed, it lost any "non-conforming structure" status it may have had. • Further, the fact that you used an existing "foundation" (in this case a deteriorating slab) has little bearing, since per Section 10.55, Subdivision 26 (E), "If any non-conforming use is destroyed by any means including floods to an extent of 50% or more of its assessed value, it shall not be reconstructed except in conformity with the provisions of this section". Removal of the old shed constituted a removal of more than 50% of its assessed value. All of the above leads City staff to conclude that you have not made and cannot make a legitimate variance application for this structure. A variance will not be granted for construction of an accessory building on the Ciry right-of-way. The offending structure must be removed immediately. The portion of your $175.00 application fee not used in legal notice publication will be returned. I suggest you relocate the structure to a conforming site on the lot. Consequently, your after-the-fact variance application has not been scheduled for the June Planning Commission meeting. You indicate it is now your position that the storage shed is actually an "ice fishing house" which you intend to move out onto the ice each winter and store temporarily on the shore in the summer. I acivised you I would review the City codes regarding the status of "fish houses". As a "shed", your building is considered as a permanent structure; as a "fish house", it is considered as a temporary structure. Both permanent and temporary structures are dealt with similarly in Section 10.55, Subd. 8 and Section 10.22, Subd. 2. Neither temporary nor permanent structures are allowed within 75' of the lake nar encroachin� past the averaae setback line. Neither you nor any other resident are allowed to store a "fish house" in the lakeshore yard not meeting the setback requirements. A temporary structure is considered hardcover, is an encroachment, and is regulated the same as a permanent structure. Your comment that many property owners on Casco Point have fish houses stored next to the lake has no bearing on your individual situation. Furthermore, our shoreline inspection tour of the Casco Point, West Arm, Forest Lake, North Arm and Carman's Bay areas on June 2nd found no more than five "fish houses" on approximately 14 miles of shoreline. They simply are not being stored on the shoreline at the vast majority of lakeshore residences. The City's position on your building has not changed and will not change no matter what you call it. Further, the City has no survey that shows this building is located or stored within your property boundaries. Subd. 7. Vibratian. Any use creating periodic earth- shaking vibrations, such as may be created from a drop forge shall be prohibited if such vibrations are perceptible beyond the lot line of the site on which the use is located. The standard shall not apply to vibrations created during the process of construction. Subd. 8, Glare or Heat. Any use requiring an operation producing an intense heat or light transmission shall be performed with the necessary shielding to prevent such heat or light from being detectable at the lot line of the site on which the use is located. Lighting in all instances shall be diffused or directed away from "R" Districts and public streets . Subd. 9. Explosives. Any use requiring the storage, utilization or manufacturing of products which could decompose by detonation shall be located not less than 400 feet from any "R" District line. Subd. 10. Screeriing Required. Screening shall be required in residential zones where: 1�. Any off-street parking area which contains more than four parking spaces and is within 30 feet of an adjoining residential lot line , and , B. Where the driveway to a parking area of more than six parking spaces is within 15 Eeet of an adjoining residential lot line. Subd. 11. Screening , Type of. The screening required herein shall consist of a solid fence or wall at least 50$ open, not less than four feet nor more than five feet in height but shall not extend within 15 feet of any street or driveway opening onto a street. The screening shall be placed along the property lines or in case of screening along a street, 15 feet from the street right- of-way with landscaping (trees, shrubs, grass and other planting) between the screening and the pavement. A louvered fence shall be considered solid if it blocks direct vision. Planting of a type approved by the Planning Commission may also be required in addition to, or in lieu of, fencing , Subd. 12. Maintenance . In all districts , all structures, required landscaping and fences shall be maintained so as not to be unsightly or present harmful health or safety conditions . � Subd. 13. Exter ior Storage in "R" Distr icts. In all "R" Districts , all mobile materials and equipment shall be stored ORONO CC 378 (4-1-84) . § 10 .60 within a building or fully screened so as not to be visible from adjoining properties, except boats and unoccupied trailers less than 20 feet in length, which are not stored for com mercial purposes, if 'stored to the rear of the house and a distance of 10 feet or more from any property line. Waste material shall not be washed into the public storm sewer system nor the sanitary sewer system without first having received a permit to do so from the City. If said permit is not granted, a method of disposal shall be devised which will not require continuous land requisition for permanent operation and will not cause a detrimental effe�t to the adjacent land. Should the waste be of solid form rather than fluid, the storage area shall be so located and fenced as to be removed from public view. In all districts, all waste material, debris , refuse , garbage, materials not currently in use for construction or otherwise regulated herein shall be kept in an enclosed building or properly contained in a closed container for such purposes, The owner of vacant land shall be responsible �or keeping such vacant land free of waste material and noxious weeds. Subd. -�.5. Drainage. No land shall be developed and no use shall be permitted that results in water runoff causing flooding, or erosion on adjacent properties. Such runoff shall be properly channeled into a storm drain, water course, ponding area or other suitable facility. Subd. 16. Traffic Control. The traffic generated by any use shall be channelized and controlled in a manner that will avoid congestion on public streets, safety hazards, or excessive traffic through residential streets. Vehicles backing from a parking space shall not back into the public street. No access drive to any lot shall be located within 20 feet of any two intersecting street right-of-way lines. Subd. 17. Radiation, Etc. No activities shall be permitted that emit dangerous radio activity beyond enclosed areas. There shall be no electrical disturbance adversely affecting the operation of any point of any eguipment including but not limited to radio and television reception other than that of the creator of the disturbance. S$C. 10.61. SPECIAL PROVISIONS. Subd. l. Signs as Accessory Use. Signs are a permitted accessory use in all districts subject to the following regulations : ORONO CC 3'79 (4-1-84) § 12.01 3 . Chapter 1305 . 6905 - Special Fire Suppression Systems with Option of Group B-2 2000 or More Gross Square Feet. Subd. 2. Organization and Enforcement. The organization of the Building Department and enforcement of the Code shall be as established by Chapter 2 of the Uniform Building Code 1985 Edition. The Code shall be enforced with the corporate limits of the City and extraterritorial liiaits permitted by States Statutes 1984. A. The Building and Zoning Department shall be the Building Code Department of the City of Orono. B. The Administrative Authority shall be the State Certified Building Official. C. The appointing Authority shall designate the Building Official for the jurisdiction of Orono. Subd. 3 . A. Permits , Inspections and Fees . Permits , inspections and collection of fees shall be provided in Chapter 3 of the Uniform Building Code 1985 Edition. B. Surcharge. In addition to the permit fee required by Item #1 , the applicant shall pay a surcharge to be remitted to the Minnesota Department of Administration as prescribed by Minnesota Statutes 1984, Section 16B.70. Subd. 4. Violations and Penalties. Shall be in keeping with Minnesota Statutes 609.033 - 609.034 which provides for a maximum fine of $700.00. It is unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure, or any part or portion thereof, including, but not limited to, the general construction, plumbing, water well, on-site sewage treat- ment system, wood stoves and fireplaces , ventilating, heating or air conditioning systems therein, or cause the same to be done, without first obtaining a separate building or general permit for each such building, structure or separate component thereof from the City; the issuance of a permit for any single component shall not imply authority for construction or inclusion of other components. The application for a permit shall include such infor- mation as may be required by the City which may vary between building components. The owner and/or occupant of any property, upon which any work has been done in violation of any Building Code or zoning requirement shall be responsible for obtaining a permit, and/or for correcting, removing or abating such violation within thirty days after notice from the City that such violation exists. When I inspected the property on August 24, 1999, I noted that the deck had been rebuilt and enlarged. Enclosed are pictures taken on October 28, 1999. The City has a history on the trailer. Mr. Wolfe had a building close to the lake which he attempted to rebuild without a building permit. The City would not allow him to rebuild the structure next to the lake so he put wheels on it and called it a fish house. However, the fish house remained on the property year round until this year when he moved it back to the lakeshore. When I inspected the property on October 28, 1999, I noted that the trailer/shed had been remo�-ed from the property. However, I wouldn't be surprised if it returned.
