NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Mimlesota: FINDINGS 1. This application was reviewed as Zoning File 09-3437. 2. The property is located in the LR-1C One Fainily Lakeshare Residential Zolling District which requires a minimum lot area of 21,780 square feet (0.5 acre) and a minimum lot width of 100 feet. 3. The City Council re�viewed this application at a public hearing held on December 14, ?009 and approved the lot width variance based on the following findings: a. The property contains 30,6?5 s.f. in area and has �9' in width at the OHWL and 65' in width at the 75' setback. b. The lot is substandard in width and a residence has existed on the property for many years. There is no additional land available to bring the lot width or lot area into confonllitv. d. The proposed residence n�eets the structural lot coverage limitation of 15%. e. The proposed residence complies with all lake yard, side yard, rear (street) yard, and avera�e lakeshore setback and hardcover requirements. 4. Tl�e City Council has considered this application including the findings and reconunendation of the Plannin� Cominission, reports by City staff, cominents by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on tl�is property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the � applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findin�s, the Orono City Council hereby grants a variance to Orono Municipal Zoniz�g Code Section 78-350 Subdivision B to allow redevelopment of a lot with �9 feet in width at the OHWL and 65 feet in width at the 7�-foot setback fi-om the OHWL where 100 feet in width is nonllally required in order to construct a new residence, subject to tl�e followin� conditions: l. Council approval is based on the survey and buildin� plans submitted by the applicants and annotated by City staf£ attached to this Resolution as Exhibits A & B. Anv amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover in Che 0-7�' zone shall not inc�rease above tl�e level of 128 s.f. or 2.5%. Hardcover in the 7�-250' zone shall be limited to 3,234 s.f. or 25%; hardcover within the 250'-500' zone shall be linlited to 3,807 s.f. ar 30% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. ADDITIONAL SURVEYS REQUIRED: a. Per City Code Section 86-68, a foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building pennit, storn�water management, gradina and drainage plans shall be submitted priar to the issuance of a Certificate of Occupancy far the residence. 4. The building plans subinitted for building permit will be reviewed to ensure conlpliance with the City's building height and number of stories regulations. 5. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their penneability as non-hardcover surfaces. 6. Required removals of existing structure and hardcover to be removed shall be completed prior to the footing inspection. 7. Authorities granted by this resolution run with the property not with tl�e applicants, but are permissive only and must be exercised by obtainina a building permit for the new construction witl�in one year of the date of Coui�cil approval, or the variance will expire on that date (Jailuary 1 l, 2011). 8. Violation of or non-compliance with any of the ternls and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority �ranted hereiil, and shall be punishable as a misdemeanor. 9. The undersigned applicants have read, understand and hereby agree to the tenns of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the prop erty.
