On August 6, 2013 the City received a building permit application to construct a one-story addition connecting the
home to the detached garage. Your application is incomplete. The following items must be submitted or revised in
order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. The copies of the survey submitted are not to scale. Please provide two, full size
certificate of surveys for our review.
2. Construction Plans. The construction plans submitted are not to scale. Please submit two, full-size sets of
construction plans for our review.
3. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement
to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will
guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required
escrow amount for this project is$2,500. An updated escrow agreement is enclosed. Please sign and return.
No additional escrow money is required at this time.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD regarding your project. Please note, the City of Orono will not issue a building permit without a copy of
MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of their
permitting requirements. The above information is required in order for the plan review to continue. Please feel free

Hi Cheryl,
I spoke with your husband Richard yesterday and from what he told me the project does not trigger any of the rules that
would require a permit from the Watershed. You are not disturbing 5000 sq ft or more and not excavating,grading or
filling anywhere close to 50 cubic yards of fill. Your land does not have any wetlands on it and you are not working in a
floodplain.
Good luck with your project and once again no permit is needed from the Minnehaha Creek Watershed district for this
project.

"Subject Property") as more fully sho n and described on Exhibit"A" attached hereto.
2. O ner requests the City to review said plans which r quires City approval including

3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owner shall deposit $ �.� with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with th� Owner, �view�g the plans, and preparing agenda packet material for City Council
review of application # I �� - �?�J!z. Eligible expenses shall be consistent with expenses the Owner
would be responsible for under a zoning and subdivision application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days of the Owner's receipt
of biil.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make
payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without
further approval of the Owner to reimburse the City for eligible expenses the City has incurred. The City shall
notify the Owner of such draw and the nature of the expense for which the reimbursement is being made. If the
Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional sums as
directed by the City, or the City shall discontinue all review.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owner when the review has been completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
