UTILITIES AND ACCESS EASEMENT � ` '*;� ����

� THIS INDENTURE, made this �day of Sept�mber; �.9$7;:�
by and between Todd V. Waters and Doris J. Molitor-Waters,
husband and wife, and Curtis J. Englund and Priscilla R. Englund,
husband and wife, hereinafter referred to as "Grantors" , and
the City of Orono, a municipal corporation, under the laws
of the State of Minnesota, hereinafter referred to as "Grantee" .
WITNESSETH, that Grantors, in consideration of the sum
of One Dollar ( $1 .00 ) and for other good and valuable consider-
ation given by Grantee, the receipt of which is acknowledged
by Grantors, does hereby grant , bargain, sell and convey to
Grantee, its successors and assigns, an easement for construction
and maintenance of utilities , together with ingress, egress
and access thereto, on, across and under the land in the County
of Hennepin and State of Minnesota, as follows :
See Exhibit A attached hereto
including, but not by way of limitation, a full and free right
and authority to enter upon said land to construct, install,
maintain, operate, and repair a sanitary sewer interceptor,
lift station, main or line, a water main or line, and the Grantee
shall have the right to make such use of said land as is reasonably
necessary and advisable to the construction installation, main-
tenance, operation and repair of the Improvement.
In addition to any other remedy the Grantee may have,
the covenants and restrictions contained herein may be enforced
by injunction.
TO HAVE AND TO HOLD said easement unto said Grantee, its
successors and assigns , permanently.
The Grantors herein certify that the lands herein described
are free and clear of all encumbrances except : mortgage,
easements , encumbrances, covenants, conditions and restrictions
of record.
IN WITNESS WHEREOF, said Grantors have set their hands
on the day and year first above written.

LEGAL DESCRIPTION -
A tract of land in Section 20, Townsliip 117, Range 23, according to United
States Government Survey thereof, described as follows: Beginning at the most
northerly corner of Lot 54 in Spring Park, thence westerly in a straight line
through a point which is located 15 feet due north from the northwest corner
of Lot 52 in said Spring Park, extended to the shore of Lake Minnetonka;
thence in a northerly direc tion along the shore of said lake to the
intersection of said shore line with a line drawn parallel with and 100 feet
northerly, measured at a right angle, from the first above described course of
this description; thence easterly parallel with and 100 feet at right angles
northerly from said first above described course, and its extension, to a
point in the center line of vacated Ivy Place in said plat of Spring Park,
said center line being a line parallel with and 25 feet at right angles
northwesterly from the northwesterly line of Lot 56 in said Spring Park;
thence southwesterly parallel with and 25 feet at right angles northwesterly
from the northwesterly lines of Lots 56 and 55 in Spring Park, said parallel
line being the center line of said vacated Ivy Place to the intersection of
said center line with the soutriwesterly line of Lot 55 as extended; thence
southeasterly along said extended southwesterly line of Lot 55 to the point of
beginning.
The southerly line of said tract being marked by two Judicial Landmarks placed
at each end of said line.
SANITARY SEWER EASEMENT
A 20.00 foot wide sanitary sewer easement over, under and across the above
described land and that part of Tract A, RLS No. 1311, which this easement
affects. The center line of said easement is described as follows:
Commencing at the southeast corner of the above described tract
of land; thence South 65 degrees 14 minutes 35 seconds West
(assumed bearing) along the south line of said tract a distance
bf 212.53 feet to the point of beginning of the center line to be
described; thence North 21 degrees 36 minutes 53 seconds East a
distance of 10.03 feet; thence North 65 degrees 08 minutes 12
seconds East a distance of 42.00 feet; thence North 18 degrees 55
minutes 17 seconds West a distance of 44.50 feet and there
terminating.
