COMMENT PERIOD NOTICE
The MCWD is reviewing the following permit application. MCWD Rules require notice to
all property owners within 600'of the proposed permitted area as a courtesy,in the event there are
any questions or concerns.
14-175: William Gust has applied for a Minnehaha Creek Watershed District permit for Erosion
Control and Floodplain Alteration for a single family home project, located at 3034 Casco Point
Road in the City of Orono.The project will result in no loss of flood storage on the 0.87 acre site
which drains to Lake Minnetonka.
Individuals with questions or concerns regarding this permit may contact Brandon Wisner at
952-471-0590 X 505 or bwisner@minnehahacreek.org.
Interested parties may request that a public hearing on this permit application be scheduled
before the MCWD Board of Managers.Requests for a public hearing must be in writing and received
at the MCWD offices prior to 4:30 PM,Mav 27`�',2014.

We have been informed by the Minnehaha Creek Watershed District that you intend to perform some land
alterations on your property. Because these projects often become a larger project than originally anticipated we
want to alert you to some related City code provisions so you can avoid the hassle and expense of obtaining an
after-the-fact permit or even having to undo some of the work.
With few exceptions, including riprap and lakeshore steps, City code prohibits the installation of impervious
surfaces within 75 feet of the lake. Any sort of fabric is considered impervious.
The following activities require a permit from the City:
• Any earth movement outside the area where rip rap is placed
• Replacement of retaining walls and/or installation of new retaining walls within 75 feet of the lake
(regardless of the height of the walls)
• Construction or replacement of lakeshore steps
• Removal of trees (dead or alive) six inches in diameter or larger within 75 feet of the lake
• Removal of vegetation on any slope within 75 feet of the lake that is too steep to easily walk
• Removal of vegetation or trimming of trees larger than six feet to provide a view of the lake from the
house
• Total or near total removal of vegetation within 75 feet of the lake not part of another permit
A tree removal permit can be arranged by calling 952-249-4600. For the other permits your contractor must
submit a permit application and plans for review. Additional information can be found at the City website,

It's to remove a section of soil (under 5 yards) within the 100 year flood elevation of 931.5' and replace with sand for a
beach area. It triggers the District's non-fast track section of the Floodplain Alteration rule which requires the public
notice. No net loss is flood storage is proposed.
