Specifically, your canopy and dock is not contained within your authorized dock use area. Based off of a recent inspection, your canopy and dock do not appear to be meeting the required setback to the west extended side site line. LMCD Code Section 1.02,subd. 3 defines an authorized dock use areas as"that area in the Lake which may be used for docks, moorings, boat storage, swimming floats, ski jump storage,or diving towers, or which may be enclosed on three sides for any of these purposes". The three side of the authonzed dock use area are defined by side setback and dock length restrictions. LMCD Code Section 2.01, subd. 2b)states that the authorized dock use area for sites bordering on the Lake is limited in width by setback limitations from the side site lines as extended into the Lake as follows: For that portion of the lenqth of the authorized The setback dock use area which extends from the shore shall be Zero to 50 feet 10 feet Over 50 feet to 100 feet 15 feet Canopies 20 feet This code section allows abutting property owners to mutually consent to adjustment of these side setback requirements on a case by case basis,which may be revoked at any time. As a result of the subdivision, the newly created lot line made the dock setback nonconforming. Docks are required to meet a 10' setback to property lines and to projected lot lines into the lake. The previous owner of the property was involved with the subdivision and was aware of the dock situation and hopefully passed the information on to you. The home built on the new lot is close to being completed and prospective buyers have been asking about the dock location. Per Resolution #3061 that approved the subdivision, the dock was to be moved the "next season" which would have been the summer of 1992. However, that did not happen and now the City must require you to do it. Please contact me or Jeanne A. Mabusth, Building & Zoning Administrator, to discuss a time table for completion.
