A CONDTIONAL IISE PERMIT
PER MUNICIPAL ZONING CODE
SECTION 10.03, SDBDIVISION 19 AND A
PERMIT PER MDNICIPAL ZONING CODE
SECTION 10.22, SIIBDIVISION 3 -
FILE NO. 995
WHEREAS, Joe Durda and Joan J. Anthony (hereinafter "the
applicants" ) are the respective owners of the properties located at 3135
and 3115 North Shore Drive within the City of Orono (hereinafter "City")
and legally described as follows:
3135 North Shore Drive - Tract A RLS No. 1113
3115 North Shore Drive - Tracts A&B RLS No. 269
(hereinafter "properties" ) and,
WHEREAS, the applicants have applied to the City of Orono for
a Conditiona 1 Use Permit to permit the repair of a sea wa 11 at 3115 North
• Shore Drive per Municipal Zoning Code Section 10.03, Subdivision 19 and per
Section 10.22, Subdivision 3 seeks permission to remove four mature trees
within 75 feet of the lake at 3135 North Shore Drive.
NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono,
Minnesota: .
FINDINGS �
1. This application was reviewed as Zoning File #995.
2. The property is located in the LR-1B Lakeshore Residential
District. .
3. On December 16, 1985, the Orono Planning Commission reviewed
the application as proposed and recommended approval based on the
following findings:
a ) The existing sea wall at 3115 North Shore Drive has
deteriorated and poses a hazard to navigation and creates erosion
problems.
b) The trees were in a hazardous condition and posed a threat of
damage to principal residence at 3135 North Shore Drive.
• c) DNR and MCWD have approved the project.

4. The City Council has considered this application including
the findings and recommendations of the Planning Commission,
reports by staff and comments of the applicant and the effect of
the proposed use on the health, safety and welfare of the
community. . .
5. The City Council finds that granting a Conditional Use Permit to
allow the repair of a sea wall and permission to remove four mature
trees within 75 feet of the lakeshore will not be detrimental to the
health, 'safety or general welfare of the public, would not adversely
affect light, air nor pose a fire hazard or other danger to
neighboring properties, nor wil 1 it depreciate surrounding property
values and that the proposed level of use of the property will be in
keeping with the intent and objectives of the Zoning Code and
Comprehensive Plan of the City.
• CONCLDSIONS, ORDER AND CONDITIONS
Based upon one or more of the above f indings, the Orono City Counci 1
hereby grants a Conditional Use Permit per Municipal Zoning Section 10.03,
Subdivision 19 to permit the repair of a sea wall at 3115 North Shore Drive
and per Section 10.22, Subdivision 3,approves the removal of four mature
trees within 75 feet of the lakeshore, subject to the following conditions:
1. Dredged material to be removed from site.
2. Owner of property located at 3135 must plant three, three inch
diameter trees within lakeshore yard by June 15, 1986 .
3. Applicants to obtain building permits for sea wall and permanent
dock.
4. Erosion control to be provided at mouth of lagoon prior to repair
of sea wall.
5. Violation of or non-compliance with any of the terms and -
conditions of this resolution shall constitute a violation of the
zoning .code, shall automatically terminate any authority granted here-
in, and shal 1 be punishable as a misdemeanor.
• 6. The undersigned applicant has read, understood and hereby agrees
to the terms of this resolution and on behalf of himself, his heirs,
successors and assigns, hereby agrees to the recording of this resolu-
tion in the chain of title of the property.
