SECTION 10.03, SDBDIVISION 19 l FILE #965 � . WHEREAS , John S. Pillsbury, Jr. (hereinafter "the applicant") is the owner of the property located at 1280 Bracketts Point Road within the City of Orono (hereinafter "City") and legally described as follows: That part of Lot 3, Rearrangement of Orono Point, according to � the recorded plat thereof, Iying Southerly of the fol. Iowing described line and its extensions: Commencing at the Southwest corner of said Lot 3 ; thence North, along the West Iine of said Lot 3 to the Northwest corner thereof, being the point of • beginning of the Iine being described; thence Southeasterly, at an angle of 64 degrees 33 minutes 30 seconds with the West Iine of said Lot 3 , to the shore of Lake Minnetonka and there terminating. , WH$REAS, the applicant has made application to the City of Orono to permit excavation and regrading of 190 yards of f i 11 within the 0-75' lakeshore setback zone and placement of 190 yards of fill within a Flood Pl.ain area, areas where no cutting or filling are normally allowed. NOW, THEREFORE, BF IT RESOLVED by the City Counci 1 of Orono, Minnesota: . FINDINGS 1. This application was reviewed as Zoning File #965. 2. The property is Iocated in the LR-lA Single Family Lakeshore Residential Zoning District. 3. The property is approximately 1.8 acres in area. 4. The Orono Planning Commission reviewed this application on September 16, 1985, and recommended approval of the proposed variance and conditional use permit to allow placement of fil.l • ancl removal of fill within the 0-75' lakeshore setback area where no excavation or placement of fill is normally allowed; and recommended approval of the conditional use permit and variance to al.low placement of fil.l within the Flood Plain area where no filling is normally allowed, based on the following findings: Page 1 of 4 . --,, �- . i" ��� . • � : d C�t o� ORONO � � RESOLUTION OF THE CITY COUNCIL � � NO. 1862 • - • • A) The proposed filling of 190 cubic yards of fill in the designated f I.00dplain area below 931.5' MSL Iocated at the interior of the lot, is being offset by an equivalent amount of fill to be removed near the lakeshore area. B) The sI.ope of the land on this Iot is less than lg overall, and the soil is rel.atively sandy, hence .,the cutting and filling has no appreciable effect on the runoff patterns of the site. C) The low curved terrace area to be Iocated east of the � �� proposed house contains no hardcover, will in part act as protection for the footings, and has no appreciable slope and therefore wiI 1 not have an effect on the runoff patterns on the property. � D) The aplicants have been granted approval for this project by the Minnehaha Creek Watershed District. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply general ly to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor � pose a fire hazard or other danger to neighboring property; would , not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the appli- cant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council finds that granting a conditional use permit to the applicant for the proposed excavation and fil I would not be detrimenta 1 to the hea lth, saf ety or genera I we 1 f are of the public, nor will. it depreciate surrounding property values and the Ievel of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. COPICLDSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby • grants a variance to Municipal Zoning Code Section 10.55, Subdivision 8 and Section 10.22, Subdivision 2 and grants a conditonal use permit per Section 10.03, Subdivision 19 to permit the excavation and regrading of fill . within the 0-75' lakeshore area and to allow placement of fill within the Flood Plain area, subject to the foll.owing conditions: • Page 2 of 4 , . . The Iocation and amount of filling and excavation shall not "� exceed that shown on the approved plan (a copy of which is attached hereto as Exhibit A) , but to the extent permitted by a other agencies, an implementation of the plan requiring Iess 'fF lakeshore disturbance is permitted. ;} .�: 2. The applicant shall take suitable precautionary measures as required by City staff to ensure that no sediment enters the Iake ' as a result of the grading and filling. • 3. Authorities granted by this variance run with the property '" not with the applicant, but are permissive only and must be ::� exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (September 23, 1985). , 4. Violation of or non-compliance with any of the terms and conditions of this variance shal.l constitute a violation of the `.� • zoning code, shall automatically terminate any authority granted herein, and shall be punishabl.e as a misdemeanor. 5. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, . his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
