A RESOLUTION AUTHORIZING THE PERMANENT AND TEMPORARY
TAKING OF LAND BY EMINENT DOMAIN FOR
UTILITY PQRPOSES FOR THE CRYSTAL BAY SEWER PROJECT
WHEREAS, the City Council has ordered preparation of a
resolution authorizing taking of land by eminent domain for
utility easement purposes at the location hereinafter specified,
� THERgFORE, Bg IT RESOLVED, by the City Council of Orono:
1. That it is hereby determined that the temporary and
permanent taking of the parcels of land set forth in paragraph 3
. hereof is necessary for the public good in order that said parcel
shall be devoted to utility purposes .
2. The City shall take by right of eminent domain for
utility easement purposes, the land described in paragraph 3
hereof, and the City Attorney be hereby authorized and directed
to commence proceedings in the District Court of Hennepin� County
for appointment of Commissioners to determine the damages, if
any, sustained by the respective owner and interests of the
property affected by such takinq as authorized by law.
That the land above referred to is more particularly
described as follows:
That part of Section lf�, Township � 117, Range 23 ,
Commenctng at a point in the west line of the northeast quarter
of the northwest quarter a distance of 395 feet 1PJ inches north
from the southwest corner thereof; thence south 35 degrees 45
minutes east 1689.9 feet; thence southwesterly at right angles
165 feet to the actual point of beginning; thence northwesterly
at right angles 231 feet; thence southwesterly at right angles to
the centerline of Lakeview Avenue; thence southeasterly along �
said centerline to its intersection with a line running
southwesterly at right angles from the point of beginning; thence
northeasterly to the beginning of the existing road.

A permanent easement described as follows :
A permanent easement for utility purposes over, under, .
and across the northwesterly 7.5 feet of the property described -
above.
A temporary easement described as follows :
A temporary easement for utility purposes over, under, �
and across the southeasterly 1P1 feet of the northwesterly 17.5 �
feet of .the property described above. .
Adopted by the Orono City Council at a regular meeting on this
�h day of July, 1985.
