A RESOLUTION AUTHORIZING THE PERMANENT AND TEMPORARY �
TARING OF LAA�D BY EMINENT DOHAIN FOR
� UTILITY PURPOSES FOR THE CRYSTAL BAY SEWER PROJECT
WHEREAS, the City Council has ordered preparation of a �
resolution authorizing taking of land by eminent domain for �
utility easement purposes at the location hereinafter specified, .
THSREFORE, BE IT RESOLVED, by the �ity Council of Orono:
1. That it is hereby determined that the temporary and
permanent taking of the parcels of land set forth in paragraph 3 .
hereof is necessary for the public good in order that said parcel
shall be devoted to utility purposes.
• 2. The City shall take by right of eminent domain for
utility easement purposes, the land described in paragraph 3
hereof , and the City Attorney be hereby authorized and directed
to commence proceedings� in the District Court of Hennepin County
•for appointment of Commissioners to determine the damages, if
any, sustained by the respective owner and interests of the
property affected by such taking as authorized by law.
That the land above referred to is more particularly
described as follows:
That part of Section 1 � , Township 117 , Range 23 ,
Commencing at a point in the west line of the northeast quarter
of the northwest quarter a distance of 395 feet l�! inches north
from the southwest corner thereof; thence south 35 degrees 45
minutes east 1458.9 feet to the actual point of beginning; thence
continue southeasterly along said bearing line 231 feet; thence
at an angle to the right of 9� degrees a distance of 165 feet;
thence northwesterly at right angles 231 feet ; thence
northeasterly to the beginning of the existing road.

� A permanent easement described as follows :
A permanent easement for utility purposes over, under, .
and across the northwesterly 7.5 feet of the property described
above.
A temporary easement described as follows:
� �` A temporary easement for utility purposes over, under,
and across the southeasterly 1�1 feet of the northwesterly 17.5
feet of the property described above.
• Adopted by the Orono City Council at a regular meeting on this
8th day of July, 1985.
