TAKING OF LAND BY EMINENT DOMAIN FOR UTILITY PORPOSES FOR THE CRYSTAL BAY SEWER PROJECT WHEREAS, the City Council has ordered preparation of a resolution authorizing taking of land by eminent domain for . . utility easement purposes at the location hereinafter specified, THERSFORE, BS IT RESOLVED, by the City Council of Orono: 1. That it is hereby determined that the temporary and • permanent taking of the parcels of land set forth in paragraph 3 hereof is necessary for the public good in order that said parcel shall be devoted to utility purposes . 2. The City shall take by right of eminent domain for utility easement purposes, the land described in paragraph 3 hereof , and the City,Attorney be hereby authorized and directed to commence proceedings in the District. Court of Hennepin County for appointment� of Commissioners to determine the damages , if any, sustained by the respective owner and interests of the property affected by such taking as authorized by law. That the land above referred to is more particularly � described as foliows: That part of Section 1P1 , Township 117 , Range 23 Commencing at a point in west line of NE 1/4 of NW 1/4 distance 395 feet 10 inches north from SW corner thereof; thence south 35° 45 ' east a distance of 1 , 248 . 9PJ feet to � actual point of beginning; thence continuing southeasterly along said bearing line 160 feet; thence southwesterly at right angles to the � intersection with a line running from a point in northwesterly line of �N RR right-of-way distance of 59.40 feet southwesterly along said right-of-way line from its intersection with north line of SW 1/4 to a point in west line of Gov't. A temporary easement described as follows : A temporary construction easement over, under, and � across the northwester ly 14J feet of the southeaster ly 17.5 feet • of the above described parcel.
