This inspection revealed that a boulder wall has been constructed along your shoreline without a permit from the Minnehaha Creek Watershed District. Enclosed please find a copy of the District rules and a permit application form. Please note that Rule F - Shoreline Improvements, specifies that no person shall construct a shoreline improvement to prevent erosion such as rip-rap or retaining wall, or for any other purpose such as boat ramps or sand blankets without first securing a permit from the District. Accordingly, you are hereby notified that you are in violation of District Rules and are required to apply for an "After-the-fact" permit from the District. A completed permit application and supporting exnibits demonstrating conformance with District standards must be submitted to the District. The required exhibits are outlined in Rule F - Shoreline Improvements. In addition, if any fill was placed during performance of this project, Rule C - Floodplain Alteration, may also apply. This matter will be reviewed by a committee of the Board of Managers on Friday, October 12, 1990. Please note further that under Rule J of the District Rules, any person who performs any work for which a permit is required under these Rules without �rst having obtained a permit from the District, shall pay to the District a fee equal to the District's cost of field inspection of the work, including investigation of the area af'f'ected by the work, analysis of the work and any subsequent monitoring of the work. Rule F - Shoreline Improvement specified that no person shall construct a shoreline improvement to prevent erosion such as rip rap or retaining wall without first securing a permit from the District. As specified in the earlier letter, you are required to apply for an "after the fact" permit from the District for this project. To date we have not received a permit application and supporting exhibits as specified. Please note that District enforcement options to ensure compliance with the rules as outlined in Rule H as follows: 1. Violation of ftules a Misdemeanor. Violations of these rules, a stipulation agreement made, or permit issued by the Board of Managers pursuant to these rules, is a misdemeanor subject to a penalty as provided by law. 2. District Court Action. The District may exercise all powers conferred upon it by Minnesota Statutes Chapter 112 in enforcing the rules adopted hereunder including criminal prosecution, injunction or action to compel conformance, restoration or abatement. 3. Administrative Order. The District may issue a cease and desist order when it finds that a proposed or initiated project presents a serious threat to soil erosion, sedimentation� or an adverse effect upon water quality or violates any rule of the District. In addition, Rule J of the District rules specifies that District may recover the District costs of field inspection of the work including investigation of the area affected by the work, analysis of the work, and any subsequent monitoring of the work in the case of a violation. You are therefore required to secure an "after-the-fact" permit from the District for this project. As we discussed on April 2, 1991 and as noted in a letter from you to the District dated March 8, 1991, additional information is required to demonstrate conformance with District standards. Required information includes a site plan showing the rip rap location and lineal footage and a cross section detailing the proposed rip rap drawn to scale with horizontal and vertical scales noted on the drawing. The detail should show the finished rip rap slope, transitional layer design and placement, distance lakeward of the rip rap placement, ordinary high water level elevation, and material specifications. This information should be submitted to the District within 10 days of receipt of this correspondence. This matter will be reviewed by the Complaints/Violations Committee at its next meeting.
