A RESOLDTION GRANTING A CONDITIONAL DSE PERMIT
. PER MUNICIPAL ZONING CODE SECTION 10.03,
SIIBDIVISIONS 19 & 20 - FILE NO. 931
WHEREAS, J. F. Fleischhacker (hereinafter "the applicant" )
is the owner of the property located at 2775 Shac�ywood Road located
, within the City of Orono (hereiriafter "the City" ) and legally
describecl as Tracts E, F & G RLS 358 (hereinafter "property" ) , and
WAFR�AS� the applicant has applied to the City for a
Conditional Use Permit to permit the removal of 35 cubic yards of fill
along a 70 foot section of shoreline and the installation of a sand
blanket per Municipal Zoning Code Section 10.03, Subdivisions 19 and
20. � . �
• NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, '
Minnesota:
Findings
l. The application was reviewed as Zoning File No. 931.
2. The property is located in the LR-1B Lakeshore Residential
, Zoning District.
� 3. On June 17, 1985, the Orono Planning Commission reviewed the :
application as proposed and recommended approval, based on
the following findings: �
. A) The 70 feet of shoreline is not high enough for rip rap to
be effective. Y
B) The installation of the sand blanketwill prevent further
erosion of black dirt into the lake.
4. The City Council has considered this application including
the f�iridings and recommendations of the Planning Commission,
� reports by staff and comments of the applicant and the effect
of the proposed use on the health, safety and welfare of� the
. � community. �

5. The City Council finds that granting a Conditional Use Permit �
� to allow the removal of 35 cubic yards of fill along a 70 foot
section of shoreline and the installation of a sand blanket
will not be detrimental to the health, safety. or general
_ welfare of the public, would not adversely affect light, air
nor pose �a fire hazard or other danger to neighboring :;
properties, nor will it depreciate surrounding property
values and that the scope of the shoreline alteration of the -
.property will be in keeping with the intent and objectives of
the Zoning Code and Comprehensive Plan of the. City.
Conclusions, Order and Conditions
Based upon the above findings, the Orono City Council hereby
� grants a Conditional Use Permit per Municipal Zoning Code Section
10. 03, Subdivisions 19 and 20 to permit the removal of 35 cubic yards of
fill from a 70 foot section�of shoreline and the installation of a sand
• blanket, subject to the following conditions:
1. Violation of or non-compliance with any of the terms and
conditions of this resolution shall constitute a violation of �
the Zoning Code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.

2. The undersigned owner has read, understood and hereby agrees
to the terms of this resolution and on behalf of himself, his
heirs, successorsand assigns, hereby agreesto the recording
of this resolution in �the chain of title� of the property.
